포락된 토지의 소유권 인정 여부에 관한 검토

육지를 둘러싸고 있는 바다 또는 해저는 그것이 영해에 속하더라도 사권의 객체로 될 수 있는 물권이나 토지로 볼 수 없다는 견해가 전통적인 입장이었다. 그에 대한 반성으로, 해면이나 하천하의 토지에 대한 사적 소유권 성부여부가 문제되었고, 오래 전부터 대법원 판례는 토지소유권의 상실원인이 되는 포락의 개념과 포락으로 인한 소유권 상실의 판단기준을 명백히 하고 있다. 본 연구에서는 먼저 포락의 개념과 판단기준에 대한 대법원의 입장 및 포락 사례를 살펴보고, 자연력에 의하여 토지 소유권 상실의 판단기준에 대한 판례의 타당성 여부를 알아보기 위하여 토지에 대한 사적소유권의 성립 여부와 해수에 의해 포락된 경우 토지소유권 상실 여부의 판단기준이 타당한지를 법리적으로 살펴보았다. 현행 판례의 입장대로 포락지에 대해 소유권을 멸실시키는 것 이외에 새로운 대안이 없는가에 대한 고심으로, 지적공부 및 등기부를 말소하지 않고 해당 소유권을 인정하여 토지를 이용하게 하는 방안을 모색해 보았다. 이를 토대로 포락 관련한 현행「공유수면 관리 및 매립에 관한법률」,「측량·수로조사 및 지적에 관한법률」과 「부동산 등기법」의 개정을 통한 법률적 대안을 제시한다.
