환경국가기준의 공동주택 음식물류폐기물 관리법에 관한 소고

A Study on the Systematic Improvement of Management and Supervision of Food Waste of Apartment Building for the Realization of Environmental State

공동주택의 음식물류폐기물과 관련하여 현행 ⌜폐기물관리법⌟, ⌜자원의 절약과 재활용촉진에 관한 법률⌟ 등이 제정되어 있지만 발생· 배출단계, 수거·분리단계, 이동·운반단계 및 재활용·자원화 단계에서 “실태파악, 인식부족 및 배출량감량부족”, “무분별한 수집 및 실효성 낮은 분리체계”, “보관부실 및 이동지연으로 인한 부패”, “재원·기술 및 자원화의 부족” 등과 같은 여러 가지로 문제점들이 나타나고 있다. 무엇보다 우리나라 국민들의 공종주택 주거비율이 높은 상황에서 공동주택에서 배출하는 음식물류폐기물로 인한 수질오염, 토지오염 등과 같은 환경문제와 함께 자원낭비의 문제도 야기되고 있는 상화에서 공동주택 음식물류폐기물에 대한 합리적인 관리·감독의 필요성이 증대되고 있다. 그러므로 본 논문에서 공동주택의 음식물류폐기물과 관련된 실태를 비롯하여 현행 ⌜폐기물관리법⌟, ⌜자원의 절약과 재활용촉진에 관한 법률⌟ 등의 입법취지, 기본원칙, 주요내용 등을 파악·분석하는 동시에 관련 법제에서 나타나는 문제점을 검토하고자 한다. 이를 통하여 환경국가원리가 성공적으로 실현되는데 있어서 중요한 자원순환사회구축 등을 위하여 공동주택에서 발생된 음식물류폐기물에 대한 합리적인 개선방향을 제시함으로써 환경보전, 국민경제의 건전한 발전 및 국민생활의 질적 향상에 이바지하고자 한다.

Today food waste disposal costs a tremendous amount of money each year. every time we throw away food, our landfills pile up higher and higher, which produce a greenhouse gas called methane. Especially, enormous mountains of food waste is created in Korean Apartment Houses. As time passes, the environmental pollution is getting worse. Above all, increasing food waste are aggravating global pollution. In this situation, ⌜Wastes Control Act⌟, ⌜Waste Recycling Promotion Act ⌟ etc was established to improve of the quality of life and the realization of environmental state principle. For example, inexact survey system, recklessness, collection method, delayed migration of food waste. But ⌜Wastes Control Act⌟ and ⌜Waste Recycling Promotion Act ⌟ is inefficient and insufficient to manage the huge amounts of apartment building. Consequently, the system of food waste needs to be rationally changed. Therefore, the aim of this study is to improve many diverse problems of management and supervision of food waste of apartment building and the Realization of Environmental State Principle.
