수산물의 제조물책임으로의 접근

2002년 7월 1일에 한국의 제조물책임법이 시행되었다. 이러한 제조물책임법에 대한 연구는 수산물 가공이 제조물책임으로 다루어질 수 있냐는 문제를 다루는 것에 의미가 있다. 즉 우리가 세계 각국과 FTA를 체결하게 됨에 따라 우리의 수산물의 수출뿐만 아니라 세계각국의 수산물 역시 우리의 시장으로 수입해 들어오게 됨에 따라 소비자의 보호를 위해서 제조물로의 적용을 검토해 볼 단계인 것이다. 이미 유럽연합의 경우 EC지침에 따라 각국의 제조물책임법에 수산물을 제조물로 적용하였거나 적용하려고 준비 중이며 미국의 리스테이먼트에서 역시 제조물로 파악하고 있다. 독일과 프랑스 역시 EC지침에 따라 수산물에 대해 제조물로 확장하기에 이르렀다. 1998 미국의 리스테이먼트에서도 수산물 가공을 제조물책임법으로 적용하고 있다. 따라서 우리의 경우도 이러한 세계의 변화에 따라 수산물의 가공에 대한 적용기준을 검토하여야 할 것으로 보인다. 또한 유전자변형 수산물이란 유전자 조작 기술을 통해 만든 수산물을 말한다. 그러나 이러한 유전자 조작은 소비자들에게 인체 및 환경에 대한 위해 가능성에 대한 우려를 나타내고 있다. 따라서 유전자변형 수산물에 대한 유용성과 더불어 위험성도 지적되고 있는 것이다. 제조물책임법 제2조 제1항에서 제조물에 대해 의미하고 있지만 그 의미를 확장해서 생각해볼 필요가 있다. 즉, 유전자변형수산물에 대해서도 제조물로 적용해야 한다는 것이다. 결과적으로 수산물의 경우도 제조물책임법의 적용대상으로 판단하는 것이 소비자의 보호라는 측면에서 볼 때 바람직하다.

The legislation of Product Liability in South korea has put in operation since July 1, 2002. This study tries to look into the applications about Products Liability Law of marine products. South Korea has signed an FTA with many countries, therefor this study necessary to import or export of marine products. It s checked the applications of Products liability for consumer protection. The European Union, France and german law on Products liability extend Products to the marine products. The Products liability Restatement pulished by American Law Institute apply to Products Liability of marine products. Therefore, the world change would check standard to marine products processing. Living Modified Organisms(LMO) is called the crops produced by genetically modified technology. But many NGO worry about a potential danger to environment and human health. Living Modified Organisms has a characteristic thing with a few merit and a variety of risk. Article 2(1) of product liability provides that product mean manufactured or processed moveables including other moveables or a apart of immoveable properties. In other words, It is necessary that Living Modified Organisms extend the scope of products by legal provisions. In conclusion, It is desirable to broaden the scope of the concept of the word products and this is desirable to consumer protection.
