집합건물의 소유 및 관리에 관한 법원에는 대표적으로 민법 및 집합건물법은 물론 그 외에 주택법 이 보충적 법원이 된다. 그러나 각 법원간의 상호관계는 명확히 정립되어 있지 않다. 본고에서 구분소유자의 소유 및 관리에 관한 권리․의무관계를 명확히 하기 위해 법원 상호간의 관계를 다음과 같이 고찰하였다. (1) 집합건물법 은 민법의 부속 법률로서 원칙적으로 민법 의 규정을 보완한다. 그러나 집합건물법의 특별규정은 민법의 규정에 정면으로 충돌하는 범위에서 우선한다. (2) 집합건물법 규정 상호간에는 동법에 특별한 규정이 없는 이상 일반법인 민법이 적용된다. 따라서 집합건물법 제3절 대지사용권의 행사에는 동법 제2절 공용부분에 관한 제10조 내지 제13조는 적용되지 아니하고. 민법 공유에 관한 제263조 등의 규정이 원칙적으로 적용된다. (3) 집합건물법 은 민법의 부속 법률로서, 주택법 은 일반 공법으로서 집합건물의 관리에 관하여 상호 보완적 법원으로서 기능한다. (4) 공동주택이 집합건물인 이상 집합건물법 은 당연히 적용되며. 주택법 의 적용을 받는 일정 규모 이상의 공동주택에도 당연히 적용된다. 또한, 공동주택의 관리에 관한 주택법 상 공동주택의 관리방법과 기준은 집합건물법이 그 방법과 기준에 정함이 없거나 반하지 않는 범위에서 보충 적용된다. 다만, 공동주택의 하자에 대한 담보책임 및 하자보수에 관하여는 주택법이 정한 범위에서 우선 적용되나 그 구속력의 근거는 주택법이 아니라 집합건물법 부칙 제6조 단서가 된다.
Not only the Civil Law and the Aggregate Buildings Law (ABL) , but also the Housing Act can be a source of the law about possession and management of an aggregate building, but their mutual relations have been not clearly established. To establish clear-cut lines of divided owner s rights and duties, in this dissertation consider mutual relations between laws as follows: (1) The Aggregate Buildings Law(ABL) is in principle supplementary to regulations of the Civil Law , but an express provision of ABL takes precedence over the Civil Law in the range of conflicts. (2) Unless there are special provisions, between mutual regulations of the Aggregate Buildings Law(ABL) are applied by the Civil Law , that is a general law (3) The Aggregate Buildings Law(ABL) , as an attached law of the Civil Law and the Housing Act , as a public law perform the function mutually complementary about management of aggregate buildings. (4) As multi-family housing is also an aggregate building, should be applied by ABL and it apply also to over a certain size of multi-family housing, that is subject to the Housing Act . Thus, methods and standards of multi-family housing on the Housing Act applies supplementary to ABL , if not contrary or not regulated.
