구분소유적 공유관계에 관한 검토

Study of some issues about the Dividing Possessional Joint Ownership.

우리나라 일련의 판례가 토지와 건물을 불문하고 인정하는 이른바 구분소유적 공유관계의 성립요건과 그 법률관계를 재검토하였다. 따라서 본고에서는 구분소유적 공유관계의 성립요건과 그 법률적 구성의 성질 및 구체적 법률관계를 판례를 중심으로 분석하여 그 타당성여부를 고찰하였다. 그 결과 구분소유적 공유관계에서는 비록 등기명의가 공유로 된 경우라도 그 내부관계에서는 그 공유자의 단독소유로 된 것이어서 통상의 공유와는 달리 공유자 우선매수권은 인정할 실익이 없고, 그 특정부분의 점유에 관하여도 자기소유 점유로 되어 취득시효의 기초가 되는 점유로는 되지 못하는 것으로 평가되고, 더욱 구분소유적 공유로 건물을 소유하고 있는 공유자가 그 건물 또는 토지지분에 대하여 저당권을 설정하였다가 그 후 저당권의 실행으로 소유자가 달라지게 되면 건물 소유자는 그 건물의 소유를 위한 법정지상권을 취득하게 되는 것으로 정리되며 이와 같은 대법원의 판례는 모두 정당한 것으로 평가된다. 다만 물권변동의 형식주의를 취하는 우리나라 법제 하에서 이와 같은 구분소유적 공유관계를 인정할 것인가는 재검토할 필요가 있음을 지적하였다.

We reexamined requirements for the conclusion and Juridical relation of the Dividing possessional joint ownership which judicial precedent of Korea recognize. So in this dissertation, analyzed requirements for the conclusion, property of juridical construction and concrete juridical relation of joint divided ownership mainly with judicial precedent and considered the validity. As a result, in the relationship of dividing possessional joint ownership is not profitable to admit a joint owner preemption, differently with normal joint ownership, because it is a independent possession of the joint owner in the internal relationship even if registered as a joint. And refers to a possession of the specific part, as becomes the possession of one’s own ownership, could not be the possession which makes the foundation of an acquisitive prescription. Thus, when a joint owner who own a building as a dividing possessional joint ownership set a mortgage about this building or land shares and afterward a owner is changed because of a execution of the mortgage, the owner of this building would acquire legal superficies. The supreme curt deserves this precedent, but on our legislative system that assume a Formalism for the fluctuation of a real right, necessity of the relationship of dividing possessional joint ownership should be reexamined.
