재건축결의에서의 비용개산액 산정에 관한 고찰

판례에 따르면 재건축 비용의 분담에 관한 사항은 구분소유자들로 하여금 상당한 비용을 부담하면서 재건축에 참가할 것인지, 아니면 시가에 의하여 구분소유권 등을 매도하고 재건축에 참가하지 않을 것인지를 선택하는 기준이 되는 것이고, 재건축 결의의 내용 중 가장 중요하고 본질적인 부분으로서, 재건축의 실행단계에서 다시 비용 분담에 관한 합의를 하지 않아도 될 정도로 그 분담액 또는 산출기준을 정하여야 하고 이를 정하지 아니한 재건축 결의는 특별한 사정이 없는 한무효라고 판시하고 있다. 그러나 「집합건물의 소유 및 관리에 관한 법률」제47조 제3항은 ‘건물의 철거 및 신건물의 건축에 소요되는 비용의 개산액’이라고만 정하고 있을 뿐, 재건축에 소요되는 비용 개산액의 구체적인 범위나 산정기준, 개산액의 분담에 관한 구체적인 기준 등에 대하여는 정하고 있지 아니하다. 비용개산액에 대한 포괄적인 산정은 나중에 최초에 정한 비용개산액의 변동이 있는 경우에 무슨 항목이, 무슨 사유로, 얼마나 증감하게 되었는지에 대하여 재건축조합원들이 검증을 할 수 있는 방법을 사전에 차단함으로써 재건축에 참여하는 조합원들의 권리침해의 가능성을 내포하고 있으며, 경우에 따라서는 재건축조합장과 시공사의 결탁에 의한 조합원들의 피해가 발생할 가능성도 있을 수 있는바, 이러한 분쟁을 미연에 방지하고, 조합원들에게 어느 정도의 비용을 부담해서 어느 정도의 신축건물을 소유할 수 있는지에 대한 투명한 비용근거를 제시함으로써 재건축에 참여하는 조합원들의 사유재산권을 보호할 필요성이 있다고 할 것이다. 이 논문은 집합건물재건축에 있어서 비용개산액 산정에 대한 실제적인 사례와 판례의 경향을 살펴보고, 나아가 구체적으로 비용개산액에 포함시켜야할 항목이 무엇인지, 그 산정기준은 어떻게 정해야 하는 지에 대하여 살펴봄으로써, 재건축결의단계에서 조합원들로 하여금 어느 정도 비용을 부담할 것인가를 사전에 합리적으로 예상할 수 있는 기준을 제시할 수 있도록 해줄 뿐만 아니라, 재건축진행단계에서 예상치 못한 설계변경이나 공법의 변경, 이로 인한 공사비의 증감이 있는 경우에 무엇 때문에 어느 정도의 부담액에 변동이 생겼는지를 합리적으로 가늠하게 해주는 척도를 제공하는데 도움이 된다고 할 것인바, 이를 통하여 조합원의 사유재산권을 보호하고, 시공사와 조합원 혹은 조합원 상호간 갈등과 불화로 인한 사회적인 비용과 손실을 줄이는 역할도 수행할 것으로 기대한다.

According to a Precedent, the subject related to sharing rebuilding expense become the creteria to section owners whether participate the rebuilding with paying appropriate expense or not with selling section ownership with the current price, and furthermore, as the most important and essential part among rebuilding resolutions, an allotted amount or calculation standard should be determined in rebuilding execution phase so far no more agreement needed which is about sharing rebuilding expenditure, if not, rebuilding resolution regarded as not valid as long as there is no particular situation. But overall estimation of rough amount expense prevents union members from verifing changed items, reasons, and how much changed when there is fluctuation in original level that it contains the possibility of infringement of union members right, and sometimes, damage occurs to union members by way of collusion between union president and construction company. Thus, There is strong necessity for union members to protect their property right and to prevent dispute. and this could be through showing the transparent expense standard. This paper presents for creteria about rough amount of expense and estimation standard for rebuilding on congregate Buildings, so that, not only union members rationally anticipate their burden in rebuilding execution phase but also let them understand the changed amount of expense when there is unpredicted change in design and construction method during rebuilding. Finally, this paper contributes to protect private ownership of property right and reduce social cost and loss by way of prevent conflict between union members and construction company or union members each other.
