오늘날 전 세계는 이동수단과 통신의 발달로 인해 국가 간의 이동이 비교적 신속하게 이루어지고 있으며, 수많은 국가에서 경험하고 있는 현상으로써 합법적ㆍ불법적으로 국경을 이동한 입국자들에 의해 각종 사회적 갈등과 문제가 발생하고 있다. 특히 무비자로 입국한 자에 의해 외국인 범죄자들이 증가하고, 이는 수용국의 법질서 혼란, 외국인에 대한 반감 증가에 따른 사회 분열, 국제테러 조직원의 입국과 국내 활동에 따른 테러 발생 가능성 등은 주로 안보문제로 다루어지고 있다. 물론 국가 간의 사증면제로 인적교류가 증가와 경제 활성화가 이루어질 수 있지만, 동시에 무사증 입국자들이 불법체류자와 난민으로의 전환이 증가할 수도 있는 점을 간과해서는 안 된다. 무비자 입국을 통한 불법체류자 및 난민의 증가는 범죄 문제를 넘어 불법노동을 통한 노동시장 교란, 외국인에 대한 반감 증가 및 여론 분열을 초래하는 인간안보의 위협 요인으로 작용할 수가 있고, 나아가 안보의 위협 요인으로도 상정할 수 있으며, 유럽 및 미국의 경우에도 이러한 현상을 이미 경험하여 사회적 이슈로 부각되고 있기 때문에 이에 대한 실태와 법적 문제에 대해 논의해야 한다.

Lastly, since Europe and the United States have already experienced this phenomenon and are emerging as a social issue, it is necessary to discuss the actual situation and legal issues.
