북한이탈주민의 법태도가 준법 의지에 미치는 영향에 대한 연구

A Study on the Effect of North Korean Refugees’ Legal Attitudes on Their Willingness to Comply with the Law

북한이탈주민은 자본주의 경제질서와 법치주의 사회질서에 대한 무지로 인해 한국 사회에서 많은 어려움을 겪고 있다. 특히, 북한이탈주민의 높은 범죄율은 우리 사회에서 더 이상 간과할 수 없는 문제점으로 인식되고 있다. 따라서, 북한이탈주민이 법치국가 사회의 진정한 시민으로서의 자질을 갖추도록 하기 위해 그들로 하여금 올바른 준법의지를 제고할 필요가 있다. 본 연구는 법태도를 인지적·정서적·행동적 영역으로 구분하여 북한이탈주민의 준법의지에 대한 영향요인을 실증하고자 하였다. 이를 위해 법지식의 헌법적 가치의 인식 및 형사법 상식, 법의 필요성, 법친밀감, 법신뢰감, 법 호응적 태도, 법 사용의사, 그리고 법효능감 등을 하위 개념으로 설정하여 검증하였다. 그 분석결과, 법 필요성, 법신뢰감, 그리고 법 사용의사 등이 북한이탈주민의 준법의지에 주된 영향을 미치는 것으로 확인되었다. 이러한 분석결과를 바탕으로 북한이탈주민의 자발적인 준법의지의 제고를 위한 정책적 시사점을 제시하였다.

North Korean refugees face many difficulties due to their ignorance of the economic order of capitalism and the social order of the rule of law. In particular, their high rate of crime victims and perpetrators shows their difficulties under the unfamiliar legal system. Therefore, in order for North Korean refugees to have qualifications as citizens of a society where the rule of law is governed, their will to obey the law must be improved. This study tried to prove the factors affecting the will of North Korean refugees to comply with the law by dividing the legal attitude into cognitive, affective, and behavioral area. For this, the constitutional value of legal knowledge, criminal law knowledge, recognition of the necessity of the law, legal intimacy, legal trust, law-responsive attitude, intention to use the law, and legal efficacy were established and verified as sub-concepts. As a result of the analysis, it was confirmed that factors such as the recognition of the necessity of the law, legal trust, and intention to use the law have a significant effect on the will of North Korean refugees to comply with the law. This paper presents policy implications for North Korean refugees to improve their awareness of the necessity of the law, their legal trust, and their willingness to use the law in order to enhance their will to comply with the law.
