지방자치법 전부개정에 따른 자치입법권의 범위에 관한 검토

A Study on the Scope of Legislative Power of Local Government Following the General Revision of the Local Autonomy Act

이 논문은 2022년 1월 시행을 앞두고 있는 지방자치법 전부개정법률에 근거하여 변화된 자치입법권의 범위를 검토하고, 이를 실질적으로 보장하고 확대할 수 있는 방안을 제시하는 것을 연구의 목적이자 내용으로 한다. 지방자치법 전부개정을 통해 지방자치단체의 자치입법권에 관한 다양한 변화가 있었는데, 조례 제정을 ‘법령의 범위에서’ 할 수 있도록 하고, 법령에서 조례로 정하도록 위임한 사항은 그 법령의 하위법령에서 그 위임의 내용과 범위를 제한하거나 직접 규정할 수 없도록 하였으며, 주민의 조례발안에 관한 사항을 따로 법률로 정하도록 하고, 주민이 규칙의 입법에 관한 의견을 제출할 수 있도록 하는 내용을 도입하였다. 또한 자치입법권의 강화에 영향을 줄 수 있는 내용으로 지방의회의 역량 강화를 위해 정책지원 전문인력을 지방의회에 둘 수 있도록 하였고, 중앙지방협력회의의 설치 근거를 마련하였다. 이러한 지방자치법의 개정내용을 바탕으로 이 논문에서는 자치입법권의 범위를 재검토하고, 자치입법권의 확대방안을 제시하였다. 자치입법권의 범위와 관련하여서는 조례제정권과 법률우위, 법률유보, 중앙정부의 하위법령과 조례와의 관계를 살펴보았다. 또한 자치입법과정에의 주민참여의 문제로서 주민조례발안제 및 규칙의 입법과정에의 주민참여에 대해 검토하였다. 자치입법권의 확대는 지방자치의 다양한 측면과 연계되는데, 근본적으로는 자치입법의 대상인 지방자치단체의 사무의 확대, 국가와 지방자치단체의 대등한 관계, 주민의 적극적 참여 등 지방자치의 핵심적 내용과 지방자치의 환경이 지방자치제의 본래의 취지에 부합하도록 실현되는 것이 필요하다.

The purpose and content of this paper is to review the scope of the changed legislative power of local government based on the Amendment of the Local Autonomy Act, which is set to take effect in January 2022, and to present measures to substantially guarantee and expand it. Various changes have been made to local governments autonomous legislative power through the full revision of the Local Autonomy Act, allowing ordinances to be enacted “within the scope of laws”, restricting or directly stipulating the contents of delegation in subordinate statutes, and allowing residents to submit opinions on the legislation. In addition, policy support experts were allowed to be placed in local councils to strengthen the capacity of local councils as a content that could affect the strengthening of autonomous legislative power, and the basis for the establishment of the Central Regional Cooperation Council was established. Based on these revisions to the Local Autonomy Act, this paper reviewed the scope of legislative power of local government and suggested ways to expand it. Regarding the scope of autonomous legislative power, the relationship between legislative power of local ordinance and precedence of statutes, statutory reservation and subordinate statutes and ordinances of the central government was examined. In addition, as a matter of residents participation in the autonomous legislative process, residents ordinance initiative was reviewed. The expansion of legislative power of local government is linked to various aspects of local autonomy, and fundamentally, it is necessary to realize the core contents of local autonomy and the environment of local autonomy, such as the expansion of local government affairs, equal relations, and active participation of residents.
