Protections for Tenants of Commercial Building during the COVID-19 Pandemic

코비드 19 팬데믹이 발생한 지난 2년 동안 세계의 경제는 매우 침체된 것으로 보인다. 특히 코비드 19 팬데믹으로 인하여 국내 일부 상가건물의 임차인들은 차임을 지급하지 못하는 상황도 발생하고 있다. 이 논문은 코비드 19 팬데믹에 의하여 대부분의 상가건물의 임대차에 있어서 상가임차인들의 차임의무가 직접적인 영향을 받았는지의 여부를 면밀하게 검토하는 것이 목적이다. 저자는 상가건물의 임차인들이 계약상의 차임을 지급하지 못하였다고 하더라도, 그것이 코비드 19의 직접적인 영향을 받은 것인지에 대해서는 보다 신중하게 검토할 필요가 있다고 생각한다. 즉 특별한 사정이 없는 한 대부분의 상가건물의 경우에는 코비드 19 팬데믹에 의하여 상가임차인들의 차임의무가 이행불능이라고 단정할 수 없을 것으로 보인다.

The COVID-19 outbreak has occurred in the past two years, and the global economy has been very sluggish. In particular, due to Covid 19, the tenants of some commercial buildings were unable to pay rent. This paper examines whether Covid 19 directly affected the rent obligations of tenants of most commercial buildings. I think that even if tenants of commercial buildings fail to pay their contractual rent, it is necessary to examine more carefully whether it is a direct impact of Covid-19. Unless there are special circumstances, I do not think that rent obligations of tenants of commercial buildings are impossible due to Covid 19.
