스포츠 분야의 부패방지를 위한 성인지 감수성과 성윤리 제고방안

Measures to improve gender sensitivity and sexual ethics for the prevention of corruption in the sports field

스포츠 성범죄는 과거부터 현재진행형인 우리 사회의 핵심 주제이다. 특히 스포츠 성폭력에 대해 2007년 문화체육관광부와 한국여성정책연구원이 각급 스포츠 팀의 구성원을 대상으로 첫 인권실태 조사를 실시한 이후 매년 인권실태 및 (성)폭력 실태를 조사하고 있다. 프로스포츠협회는 인기 5대 스포츠(축구, 야구, 농구, 배구, 골프)에 대해 선수들을 대상으로 성폭력실태 조사를 실시하여 스포츠성폭력문제를 진단하는 자료로 활용하였고 정책적 대안을 위한 기초자료를 제공하였다. 사회와 문화 속에서 구조적으로 형성된 성차별적 가치이며 양성 평등의 실현을 위한 사회적·집단적 지적 능력이라고 할 수 있다. 더욱이 스포츠분야에와 같이 지도자와 선수간의 수직적 관계가 형성된 영역에서는 성범죄 입증에 있어서 매우 긍정적인 효과를 기대할 수 있다. 그러나 ‘성인지 감수성’이 성범죄의 입증에 있어서 효과성은 나타내기 위해서는 일반적이고 객관성 있는 피해자의 평균적 특성과 심리적 상태 등을 보장할 수 있는 기준마련이 필수적이다. 그리고 스포츠 영역에서의 성범죄예방을 위한 대응방안으로 성윤리에 대한 체계적 프로그램의 시행과 스포츠시설에서 ‘범죄예방환경’을 조성하는 것이 스포츠 성범죄를 예방하는 방안이 될 수 있다. 이는 스포츠 분야에서만 요구되는 것이 아니라 범죄예방을 위한 다양한 분야에서 시행될 수 있는 방안이다. 또한 스포츠 영역에서의 수직적 관계의 개선도 요구된다. 성범죄가 발생했을 때 피해자에 대한 2차가해의 위험과 조직적 은폐와 회유 등은 더 큰 문제를 제기할 수 있기 때문에 피해자의 피해가 외부에 노출되지 않는 장치를 마련하고 피해자가 조직에서 또 다른 피해를 당하지 않도록 제도적 장치가 마련되어야 할 것이다. 그 동안 스포츠 영역에서의 인권침해와 관련하여 많은 제도적 권고와 개선이 있었음에도 아직도 현장에서는 이러한 제도가 정착되고 있지 않고 있는 실정이다. 이에 대해 해양 영역에 종사하는 자 뿐만아니라 전 국민이 관심을 가지고 지켜보아야 할 것이다.

‘Gender sensitivity’ is a gender-discriminatory value structurally formed in our society and culture, and it can be said that it is a social and collective intellectual ability for the realization of gender equality. Moreover, a very positive effect can be expected in proving sexual offenses in areas where a vertical relationship between a leader and an athlete is formed, such as in the sports field. However, in order to show the effectiveness of adult susceptibility in proving sex crimes, it is essential to establish a standard that can guarantee general and objective characteristics and psychological status of victims. In addition, as a countermeasure for the prevention of sexual crimes in the sports field, the implementation of a systematic program on sexual ethics and the creation of a crime prevention environment in sports facilities can be measures to prevent sex crimes in sports. This is not only required in the sports field, but is a measure that can be implemented in various fields for crime prevention. In addition, improvement of vertical relationships in the sports field is also required. When a sexual offense occurs, the risk of secondary harm to the victim and systematic concealment and conciliation can pose a bigger problem. Institutional arrangements should be put in place to avoid being hit. In the meantime, although many institutional recommendations and improvements have been made in relation to human rights violations in the sports field, these systems are still not being established in the field. In this regard, not only those who are engaged in the maritime sector, but the entire nation should watch with interest.
