Realization of the Right to Information Self-determination and Utilization of Data in the Interoperability System of IoT, Blockchain and AI (2): Focused on MyData and Data Trust -

PDS 등의 데이터 관리, 저장시스템의 기술적 지원과 데이터 이동권이라는 법적 지원에 의해 뒷받침되는 마이데이터 모델은 정보주체가 자신의 개인정보에 대한 통제권을 잃지 않으면서 효율적인 활용을 할 수 있게 한다. 고도의 정보화시대에 진정한개인정보자기결정권을 실현할 수 있는 방안으로 주목받고 있다. 특히 EU의MyHeatlthMyData 사례와 같이 사물인터넷, 블록체인, 인공지능의 상호운용을 통한 마이데이터 모델은 데이터의 수집기술(사물인터넷)과 분석기술(인공지능)을 분산원장기술(블록체인)과 연결함으로써 정보주체의 통제권을 보장하고, 투명성과 효율성을증진시킨다. 그럼에도 불구하고 현실적인 측면에서 마이데이터 모델은 한계가 있을수밖에 없는데, 주도적으로 개인정보에 대한 통제와 활용을 선택하고 범위와 조건을결정해야 할 정보주체의 역량이 제한적인데다가 지속적인 사후 모니터링과 리포트를통한 사후 통제를 실현하기 어려운 구조적인 문제가 있다. 이를 해결하기 위하여, 전문성과 역량을 가진 수탁자가 정보주체의 정보부족과 미흡한 협상력을 보완하여 위임의 범위 내에서 정보주체 대신 개인정보처리자와 구체적인 합의를 도출하고 사후모니터링과 정기적인 리포트를 통해 정보처리에 지속적으로 관여하는 데이터 신탁이중요한 의미를 갖는다. 특히 사물인터넷, 블록체인, 인공지능의 상호운용과 연계된 마이데이터 플랫폼에 데이터 신탁이 결합됨으로써 동의를 통한 일방적 이익추구가 아닌 적극적 합의를 통해 상호이익을 추구하는 공정한 합의 모델에 기반한 개인정보자기결정권의 실현에 한 걸음 더 다가가게 된다. 결국 이 모든 프로세스는 윤리적 정당성과 상호신뢰에 기반을 둔 거버넌스 시스템의 구축으로 귀결된다.

The data subject can keep control of his/her personal information and make use of it effectively with a MyData model that has technical support such as PDS, data management and storage systems, and legal support of right to data portability. MyData model is the way where the right to information self-determination can be realized in the digital information age. Especially, the interoperability model of IoT, blockchain and AI can assure control of the data subject and improve transparency and effectiveness. Nonetheless, MyData model has difficulty in obtaining practical effects due to data subject’s limited capacity to strike a balance between protection and sharing of his/her personal information and structural limitations in the continuous post-control. Therefore, the Data Trust which can make up for information insufficiency and the insufficient bargaining power and conduct continuous post-control has important significance. The combination of Data trust and MyData model linked with the interoperability model of IoT, blockchain and AI could realize the right to information self-determination based on the model of a fair agreement, and It would lead to the governance system based on the ethical justification and mutual trust.
