피해자 보호를 위한 합리적인 데이트폭력 규제 방향

Guidelines for Reasonable Regulation of Dating Violence for Victim Protection: Focusing on the setting the scope and the application matter of the crime that should not be punished against the victim’s will

범죄를 예방하고 피해자 발생을 방지하기 위한 방안으로는 사전예방과 사후조치를 고려해 볼 수 있다. 사전예방은 형벌을 예정하여 위하효과를 발생시키는 것을 통해 범죄를 방지하여 피해자 발생을 사전에 예방할 수 있게 하며, 범죄가 발생한 후에는 사후조치를 통해 추가범죄가 발생하지 않도록 하고, 한편으로는 피해자에 대한 보호조치 등을 잘 하는 것이 중요하다. 데이트폭력에 대한 규율은 사안의 유사성 등에 기인하여 가정폭력이나 스토킹과 함께 논의되는 경향이 있었으나, 차이점이 분명 존재한다. 그런데 가정폭력과 스토킹은 별도 입법을 통해 규율되고 있지만 데이트폭력은 그렇지 않다. 본고에서는 이러한 점에 착안하여, 데이트폭력과 가정폭력, 스토킹 그리고 일반 폭력범죄와의 유사점과 차이점 비교를 통해 현행체제에서는 피해자 보호를 위해 별도 입법에 의한 규제가 필요함에 대해 검토하였다. 이를 위해 여러 관련 쟁점들 중 데이트폭력 개념에 대한 정의의 문제와 반의사불벌 적용 여부에 대한 부분을 중심으로 살펴보는 한편, 폭력전과공개제도 도입 문제와 피해자보호를 위해 기타 고려해야 할 부분들에 대해 살펴보았다.

Ex-ante prevention and ex-post measures can be considered as ways to prevent crimes and stop the generation of victims. The former entails preventing the creation of victims by stopping crimes through a deterrent effect, which works through the expectation of punishment. Once a crime has occurred, it is important to take protective measures for the victim and to prevent the occurrence of further crimes. Regulation of dating violence is usually discussed together with domestic violence or stalking because of the similarities between them. However, there are some definite differences. Although domestic violence and stalking are regulated by separate lawmaking, there is no such regulation for dating violence. Considering this point, this study examined the need for separate legislation for victim protection in the current system by comparing the similarities and differences of dating violence and domestic violence, stalking, and general violent crimes. Among the various issues, the study focused on the definition of the concept of dating violence and the application of the no-punishment-against-will rule. In addition, the study examined the introduction of the violence disclosure system and other issues that need to be considered for victim protection.
