남북연합과 남북 형사사법 협력에 대한 연구

Inter-Korean Union and Inter-Korean Criminal Justice Cooperation from the perspective of international law

2017년 5월 10일 문재인 대통령은 취임식에서 한반도 평화를 언급하며, 평화 정착을 위해 노력하겠다는 것을 밝혔고, 실제 재임기간 동안 남북정상회담을 3번이나 개최하였다. 그 뿐 아니라 북미 관계 개선을 통해 한반도 안정화 도모하고자 북미회담까지 주선한 것으로 알려졌다. 2018년 4월 남북정상회담을 앞둔 상태에서 언론사 간담회에서 “종전선언 거쳐 평화협정의 체결로 나아가야 합니다. 고 하며 종전선언과 평화협정에 대하여 언급했고, 최근에는 유엔과 G20정상회의에서 또 다시 종전선언과 평화협정을 이야기했다. 종전선언은 한국전쟁이 공식적으로 끝났다는 것을 의미하고, 평화협정은 종전선언을 바탕으로 남북이 군사 대치 및 행동을 중지하고 평화상태를 회복하거나 우호관계를 발전시키기 위하여 협정을 맺겠다는 것이다. 통일과 관련해서 2000년 남북정상회담에서 남북연합을 통일형태로 선택했지만, 남북연합이 무엇인지 명확하지 않다. 다만 남북의 정치, 경제 등을 고려할 때 남북연합은 국가연합이 아니라 영연합 같은 형태가 될 것이다. 남북연합을 만들어지기 위해서는 남북이 서로를 국제법상 개별 주권국가로 인정하고 동시에 서로의 정부를 합법정부로 인정해야 한다. 그리고 남북은 조약이나 협약을 통해 형사사법 협력해야 한다. 조약 또는 협약에 따라 형사사법 협력을 하게 되어도 남북은 서로 개별 주권국가이기 때문에 주권을 침해하지 않도록 일반적인 국제법 원칙에 부합하는 행동을 해야한다.

The declaration of war means that the Korean War is officially over, and the peace agreement means that the two Koreas will sign an agreement to stop military confrontation and action, restore peace, or develop friendly relations based on the declaration of war. Regarding unification, the inter-Korean union was chosen as the form of unification at the 2000 inter-Korean summit, but it is not clear what the inter-Korean union is. However, considering the politics and economy of the two Koreas, the inter-Korean union will be in the form of the British Union, not the national union. In order to create an inter-Korean union, the two Koreas must recognize each other as individual sovereign states under international law and at the same time recognize each other s governments as legal governments. And the two Koreas should cooperate in criminal justice through treaties or agreements. Even if criminal justice cooperation is made under a treaty or agreement, the two Koreas are individual sovereign states, so they must act in accordance with general international law principles so as not to infringe on sovereignty
