태국의 투자환경과 외국인 투자법제에 관한 고찰

A Study on Investment Environment and Foreign Investment Laws in Thailand

본 연구는 아세안 국가 중 경제성장이 가장 높은 국가 가운데 하나인 태국의 투자환경 및 투자법제에 대해 분석하고 있다. 본 연구를 위해 핵심 외국인 투자 법규인 외국인사업법, 투자진흥법, 산업단지공사법을 중심으로 조항별 주요내용을 살펴보고 실무적 유의사항을 제시하고 있다. 외국인사업법은 외국 기업의 태국 내 진출 시 제한 분야를 두고 있으며, 세부적으로 3가지 항목으로 나누어 외국인투자 진출에 업종별 제한을 두고 있다. 다음으로 투자진흥법은 투자진흥 목적으로 외국인들의 활동을 장려하지만 해당 법에 따라 구성된 위원회를 통하여 이들에 대한 관리와 활동에 대한 혜택 및 제한 역시 결정할 권한을 가지고 있다. 끝으로 산업단지공사법은 산업단지는 물론 자유구역 설치에 대한 내용을 법으로 두고 수출과 수입 시 해당 지역의 관리 및 통제를 하고 있다. 이를 위해 본 법에 따라 설치된 위원회에서 각종 규제 및 관리에 관한 권한을 행사한다. 본 연구는 이들 법규들을 분석함으로서 외국인투자자들의 태국 진출 어려움을 사전에 제거하고 무역업자들의 혜택을 확대시킬 수 있는 방법에 대해 제시하고자 한다. 본 연구를 계기로 정부는 기업들의 투자 진출 제한 요소들에 대한 장벽을 제거할 수 있도록 정부 간 협상을 추진함으로서 교역 확대를 위한 발판을 마련할 수 있을 것이다.

Purpose: The purpose of this study is to make practical precautions and policy proposals through the analysis of Thailand s investment environment and Laws. Research design, data, methodology : This study compares and analyzes the main provisions of foreign investment-related laws and regulations. For analysis, specific provisions of the Foreign Business Act, the Investment Promotion Act and the Industrial Estate Authority Thailand Act are analyzed intensively. And it also analyzes Thailand s investment environment based on objective indicators by Investing Across Borders in World Bank. Results : The Foreign Business Act can analyze the results of limiting factors for each industrial field. Through the Investment Promotion Act, foreign investment-related benefits and restrictions can be analyzed. Finally, through the Industrial Estate Authority Thailand Act, precautions for the establishment of free zones related to imports and entry into the region are analyzed. Conclusions : It is confirmed that the government s negotiations are needed to prevent non-trade barriers under domestic laws and regulations from occurring when foreign companies enter the market.
