A Practice of Legal Arguments for AI Lawyers: Absolute Effect of Suspension of Extinction Prescription Following the Exercise of Bill Claims in Joint Debt

수인의 연대채무 관계에서 어느 연대채무자 1인은 자신의 채무이행을 담보하기 위해 채권자에게 어음을 발행해 줄 수 있고 그러한 어음채권의 행사는 그 연대채 무자에 대한 원인채권의 소멸시효를 중단시킨다. 본고에서는 이를 확장하여 어느 연대채무자에 대한 어음채권의 행사가 다른 연대채무자에서도 소멸시효 중단의 효과를 발생시킬 수 있는지 여부를 다루고 있다. 어음행사는 원인채권을 청구한 것으로 볼 수 있고 연대채무자에 대한 이행청구 는 다른 연대채무자에게도 절대적 효력이 있다는 점에 근거하여 긍정하는 견해가 있을 수 있는 반면, 연대채무에서는 원칙적으로 효력의 상대성 원칙을 따라야 하 고 어음채권 청구와 원인채권 청구는 엄연히 별개의 청구이므로 절대적 효력이 미 치는 이행청구의 범위를 부당하게 확대해서는 안 된다는 반대견해도 일리가 있다. 본고에서는 술어논리라는 수학적 도구를 이용하여 기존의 법리에 부합하면서 도 최대한 객관적인 답을 찾고자 노력하였다. 그 결과 어느 연대채무자에 대하여 어음채권을 행사하면 다른 연대채무자의 채무도 소멸시효가 중단된다는 사실을 연역적으로 도출하였다. 자연어로 기술된 법리를 술어논리로 표현·논증함으로써 인공지능 변호사와 같은 기계가 법을 해석하고 자문할 수 있는 토대를 마련했다는 점에서 학문적 의미가 있다. 다만 입법취지, 정책방향 등 주관적인 요인을 반영할 수 없다는 단점이 있으므로 향후 연구에서 이에 대한 보완책이 마련되어야 한다.

In the joint debt relationship of several persons, one joint debtor may issue a bill to the creditor in order to guarantee the performance of his/her obligation, and the exercise of such a bill of interest suspends the prescription of the cause of the claim against the joint debtor. This paper expands this to deal with whether the exercise of the bills claim against one joint debtor can cause the effect of interruption of prescription for other joint debtors as well. There may be positive views based on the fact that the exercise of bills can be regarded as a claim for a claim for cause, and a request for performance to the joint and joint debtors has an absolute effect on other joint and joint debtors. On the other hand, there is also the opposing view that, in principle, the principle of relativity of effect should be followed, and the claim for bills and claims for cause are distinctly separate claims, so the scope of the claim for performance, which has absolute effect, should not be unreasonably expanded. In this paper, using a mathematical tool called predicate logic, I tried to find an objective answer as much as possible while conforming to the existing legal principles. As a result, it was deduced deductively that if a bill claim is exercised against one joint and another debtor, the prescription of extinction of the debts of other joint and joint debtors is also suspended.
