대북제재 하에서의 남북 산업재산권 교류협력을 위한 방향

Direction of Inter-Korean Industrial Property Exchange and Cooperation under Sanctions on North Korea

현재 유래없이 강력한 UN의 대북제재가 계속됨에 따라, 전방위적 산업 분야에서 남북간의 교류가 답보된 상태이다. 이러한 전체적인 분위기는 산업재산권 분야도 마찬가지인데, 산업재산권은 비교적 정치적으로 중립적인 성격을 가짐에도 불구하고, 남북 간에는 상호 간의 특허⋅상표를 인정하기 위한 가장 기초적 교류조차 이루어지지 않고 있다. 그러나, 산업재산권은 국제적 규약에 따라 표준화가 상당히 진행된 분야로서, 현행 국제적 규약을 활용해서라도 교류의 폭을 넓힐 수 있으며, UN의 대북제재의 영향을 최소화하면서도 남북이 협력을 지속할 수 있는 분야이기도 하다. 또한, 산업재산권은 산업⋅경제를 발전시켜 나가기 위한 핵심 인프라로서, 향후 대북제재가 완화되어 남북경협이 재개될 때 이를 안정적으로 추진하는 원동력이 되는 중요한 제도가 될 수도 있다. 이에, 본 주제에서는 광범위한 대북제재가 이루어지고 있는 현행 환경 하에서, 남북이 장기적인 경제협력 및 산업재산권 인프라 구축을 위한 방향을 모색하기 위하여, 먼저, 북한의 산업재산권 관련 법제 및 환경을 남한과 비교해보고, 상호간의 산업재산권 인정 현황을 검토한 뒤, 구체적인 실행 방안으로서, 남북 당국의 합의안 도출, 남북 산업재산권 전담기구 설립, 북한의 산업재산권 관련 환경 구축 지원, 인도적 차원의 산업재산권 활용 적정기술 개발⋅보급, 민간차원의 협력 방안을 순차적으로 살펴보고자 한다.

As the United Nations continues to impose unprecedented strong sanctions on North Korea, exchanges between the two Koreas are stagnating at all-round industries. This is the same in the field of industrial property, although industrial property system is relatively politically neutral. Industrial property system is the area where standardization has progressed considerably in accordance with international conventions, and the two Koreas can expand exchange using current international conventions. This is also the area where the two Koreas can continue cooperation while minimizing the impact of sanctions on North Korea. In addition, industrial property system is key infrastructure for developing industries and economies, and can be the driving force for stable promotion when inter-Korean economic cooperation resumes in the future. In this paper, the study was conducted to find directions for long-term economic cooperation and industrial property infrastructure between the two Koreas. Specific action plans include concluding agreements by inter-Korean authorities, establishing an organization dedicated to inter-Korean industrial property system, supporting North Korea s establishment of a system related to industrial property, humanitarian assistance using appropriate technologies, and private-level cooperation.
