온라인 환경에서 신원확인 및 신뢰서비스에 대한 법제 연구

Legal research on Identity Verification and Trust Services in an online environment: Focusing on the EU s eIDAS regulation and the UN s identity management regulation (draft)

온라인 환경에서 신뢰는 경제적, 사회적, 기술적 발전의 핵심 요소이다. 그러나 디지털 경제의 기반인 전자거래가 일상화되면서 디지털 시장의 분열, 상호호환성 부족, 사이버 범죄의 증가와 같은 장애에 직면하고 있다. 이러한 장애를 극복하기 위해서는 전자거래 이용자의 신뢰를 보장할 수 있는 법적 기반이 필요하지만, 기존의 법체계는 특정 분야에 국한된 입법을 통하여 온라인 환경의 변화에 대응해 왔다. 하지만 특정 분야에만 적용되고 기술적으로도 고립된 개별 법률은 온라인 환경의 경제적, 사회적, 기술적 변화에 대응하는데 부적합하고 비효율적이다. 온라인 환경의 법체계는 전자거래의 안전하고 신뢰할 수 있는 수준의 보장을 넘어 이용자에게 편리성을 제공하는 포괄적인 법체계로 전환할 필요가 있다. 최근 유럽연합의 eIDAS 규정과 국제연합의 신원관리규정은 법제도 측면에서 신원확인 및 신뢰서비스의 확대를 촉진하기 위한 균일한 법률 규칙을 제시하고 있다. 이러한 신원관리에 관한 국제규범은 온라인 환경의 신뢰를 확립하여 전자거래의 법적 확실성을 보장하며, 또한 지속 가능한 발전과 사회적 통합에도 기여할 수 있다. 이하에서는 종이문서 중심의 엄격한 형식주의에 터 잡아 발전된 기존의 법체계가 온라인 환경에서 직면하고 있는 법적 과제를 해결하기 위하여 제정된 국제규범을 살펴보기로 한다. 이를 토대로 우리나라의 법제 현황을 비교 검토하고, 그 정비 방안을 제시해 보고자 한다.

In the online environment, trust is a key factor in economic, social and technological development. However, as electronic transactions, the basis of the digital economy, become commonplace, it faces obstacles such as fragmentation of the digital market, lack of interoperability, and an increase in cybercrime. In order to overcome these obstacles, a legal basis to guarantee the trust of electronic transactions users is required, but the existing legal system has responded to changes in the online environment through legislation limited to specific fields. The legal system of the online environment needs to be converted into a comprehensive legal system that provides convenience to users beyond guaranteeing a safe and reliable level of electronic transactions. Recently, the European Union s eIDAS Regulations and the United Nations Identity Management Regulations propose uniform legal rules to promote the expansion of identity verification and trust services in terms of legal systems. These international standards for identity management ensure legal certainty of electronic transactions by establishing trust in the online environment, and can also contribute to sustainable development and social cohesion. In this study, the existing legal system developed from the strict formalism centered on paper documents will look at the international norms enacted to solve the legal problems faced in the online environment. Based on this, we would like to compare and review the current state of Korea s related laws and suggest ways to improve them.
