스마트 헬스케어 발전을 위한 의료･건강정보 활용방안 연구

A study on medical and health information legislation for the development of smart healthcare: Regarding the provision of smart healthcare in the house

우리는 이미 4차 산업혁명의 한 가운데에 있다. 기술진보는 매우 빠르게 진행되고 신산업과 새로운 서비스는 급속도로 생성되고 발전한다. 변화의 흐름에 신속하고 민첩하게 그리고 적극적인 입법적 대응이 필요하며, 그에 따라 비교법적 연구도 중요성을 더하고 있다. 의료분야를 포함한 스마트 헬스케어 발전을 위해서는 의료 및 건강정보의 보호뿐만 아니라 활용도 중요하다. 지난 10 여년간 입법적으로 꾸준한 발전을 보여온 일본의 법제를 비교･검토하는 것은 유의미한 작업이다. 차세대의료기반법은 일본의 입법대응의 결정체라고 할 수 있다. 이 법은 의료정보･익명가공정보 등의 개념을 명확하게 하고, 의료정보의 활용체계를 구축하였으며, 익명가공정보 인정사업자에 대한 승인(특허)제도와 강력한 통제수단을 두었다. 또한 이 법은 의료정보 취급사업자에 대한 정보취급상의 의무부과 등에 관한 사항을 규율하면서 성공적으로 의료정보를 활용하고 신산업의 창출에 기여하고 있는 것으로 판단된다. 우리나라는 개인정보보호 위주의 체계에서 조금은 벗어나고 있지만, 급속한 변화를 겪는 지금의 상황에서는 입법적 대응에 있어 부족한 면이 있다. 일본의 차세대의료기반법을 모델로 삼을 필요가 있다. 즉, 입법자는 스마트 헬스케어와 각 정보의 개념을 적극적으로 정의하고, 의료정보를 포함하여 폭넓게 스마트 헬스케어 정보의 활용체계를 구축하며, 이를 실무적으로 지원하고 입법에 나설 적합한 행정조직을 만들 필요가 있다.

We are already in the middle of the 4th industrial revolution. Technological progress is progressing very rapidly, and new industries and services are created and developed rapidly. A rapid, agile, and active legislative response to the flow of change is required, and comparative law research is also increasing in importance accordingly. For the development of smart healthcare including the medical care, it is important not only to protect but also to utilize medical and health information. It is a meaningful task to compare and review Japanese legal systems, which have shown steady legislative development over the past decade. The Next-Generation Medical Infrastructure Law can be said to be the culmination of Japan s legislative response. This Law clarified the concepts of medical information and anonymous processed information, established a system for using medical information, and an approval (patent) system and strong control measures for businesses that recognize anonymous processed information. In addition, this Law is judged to be contributing to the creation of new industries by successfully utilizing medical information while regulating matters related to the imposition of information handling obligations on Medical information handling business operators. Korea is a little out of the privacy-oriented system, but in the current situation that is undergoing rapid change, there is a lack of legislative response. It is necessary to use Japan s Next-Generation Medical Infrastructure Law as a model. In other words, it is necessary for legislators to actively define the concept of smart health care and each information, establish a system for using smart health care information in a wide range including medical information, and create an appropriate administrative organization to support it in practice and legislate.
