본 연구는 현대사회에서 주거편리와 쾌적한 주거환경 충족을 위해 필연적으로 진행될 수 밖에 없는 도시개발사업에 대하여 살펴 보았다. 특히 최근 사회적 이슈가 되고 있는 LH 사태와 대장동 사건을 통해 문제점을 고찰하였으며, 어떻게 하면 이러한 문제점을 개선할 수 있을까 고민하는데 초점을 두었다. 특히 토지공개념에 기초해 도시개발과 기반시설 형성으로 인한 토지가치 상승분을 개인이나 주관기관이 아닌, 시민에게 돌려주는 개념의 시민환원제라는 방안을 새로이 모색하였다. 개발이익의 시민환원제가 실현되면 개발이익은 전액 환수되고 사업에 참여하였던 시공사는 공사수익을, 금융기관은 이자수익을, 용역사는 용역수익을 가져가게 된다. 그러나 시행사업자는 수익은 무엇인가의 문제가 발생한다. 즉 시행사업자가 사업을 추진할 동인은 무엇인가 하는 문제로 이에 대한 해소방안으로 시행사업자의 사업 참여에 대한 성과급 지급으로 공정성과제를 함께 모색하고자 하였다. 이는 최근 문제가 불거졌던 LH 사태나 성남 대장동 사건 등을 반면교사 삼아 향후 도시개발사업이 시민과 함께 할 수 있는 제도적 장치를 마련하는 하나의 방안 모색이 아닌가 생각된다.
This study examined urban development projects that inevitably proceed to meet residential convenience and a pleasant residential environment in modern society. In particular, the problems were reviewed through the LH incident and the Daejang-dong incident, which have recently become social issues, and the focus was on how to improve these problems. In particular, based on the public concept of land, a new plan was sought to return the increase in land value due to urban development and infrastructure formation to citizens, not individuals or organizations. When the citizen return system of development profits is realized, development profits will be fully recovered, and construction companies that participated in the project will take construction profits, financial institutions will take interest income, and service companies will take service profits. However, the implementer has a problem of what revenue is. In other words, as a solution to the question of what driving the implementer to promote the project, it was intended to seek fair performance tasks by paying incentives for the implementer’s participation in the project. This is considered to be a way to prepare an institutional mechanism for future urban development projects with citizens by taking advantage of the LH crisis and Seongnam Daejang-dong incident, which have recently raised problems.
