가상화폐를 통해 범죄수익을 세탁하는 신종 텔레그램 범죄집단에 대한 규제 검토

Review on Regulations on New Telegram Crime Syndicates that Launder Criminal Profits through Cryptocurrency - Focusing on the Case of the Incheon Telegram Drug Group Room Investigation -

20222년 현재 텔레그램, 위커 등 보안성이 강화된 SNS의 사용이 범람하고 있고, 가상화폐는 법정통화의 지위를 넘보고 있다. 특히, 텔레그램, 비트코인은 특유의 익명성, 보안성으로 인해 마약, 보이스피싱, 성범죄 착취물, 탈세 등 각종 범죄에 전 방위적으로 사용되고 있다. 텔레그램, 가상화폐를 범행수단으로 서로 만난 적 없는 사람들이 텔레그램으로 범행을 모의한 후 범죄를 실행, 범죄수익은 가상화폐를 통해 세탁 하는 신종 범죄들이 대두하고 있으나, 가상화폐, 텔레그램의 익명성·보안성으로 인해 아직까지 범죄 실질에 맞는 수사, 범죄수익 환수가 제대로 진행되기가 어려운 것이 현실이다. 본 논문에서는 필자가 2021년 4월~10월 진행한 실제 수사 사례 (텔레그램 마약조직을 최초 범죄집단으로 의율, 기소한 사례)를 중심으로, 텔레그램 상에서 이루어지는 마약 조직의 동향 및 규제 방안, 효율적임 범죄수익 환수를 위한 방법을 검토하기로 한다.

Currently in 2022, there has been an influx in use of social media with upgraded security features such as Telegram and Wickr, and cryptocurency is looking to take the status of legal currency. In particular, due to its anonymity and security, Telegram and Bitcoin are being used widely for various crimes such as drugs, voice phishing, sexual exploitation, tax evasion, etc. There has been rising concerns on new crimes in which people who have never meet conspire to commit crimes using Telegram, then connit crimes and launder the criminal profits using cryproctrurrency using Telegram cryptocurrency as tools for crimes. However, due to the anonymity and securith of cryptocurrency and Telegram, investigations and confiscation of criminal profits cannot be carried oyt in accordance to how the crimes are committed. This study reviews the trends of crug sundicates, regulatory measures, and efficient measures for confiscating criminal profits by focusing on actual investigations (case in which a Telegram drug syndicate was tried and prosecuted for the first time) conducted from April to October of 2021.
