스마트 교정 도입을 위한 법제 개선 방안연구

A study on the Improvement of Legislation for the introduction of smart corrections

교정분야는 교정공무원의 업무부담ㆍ과밀수용ㆍ인권침해 등의 문제가 상존하며, 이를 해결하기 위한 방안으로 스마트 교정(smart corrections)의 도입과 활용이 대안으로 떠오르고 있다. 하지만 스마트 교정이라는 개념을 교정현장에 도입ㆍ활용하기 위해서는 선결하여야 할 법률적인 문제가 존재하는바 이 연구는 스마트 교정과 관련한 주요 이슈에 대한 논의, 관련 법률에 대한 분석을 실시하고, 이를 바탕으로 스마트 교정의 도입과 교정시설에의 적용을 위해 기초적 법률대안을 제시하는 것을 연구의 목적으로 한다. 이를 위해 스마트 교정관련 법적 환경ㆍ주요 법률ㆍ국가인권위원회의 주요 권고사항 등을 분석하여 스마트 교정의 도입을 위한 법률적 문제점을 분석하였으며, 이를 바탕으로 스마트 교정의 대표적인 사례인 이동형 CCTV, 스마트 밴드를 도입하기 위해 「형의집행및수용자의처우에관한법률」과 같은 법 시행규칙을 관련 법령과의 용어 통일, 급속도로 발전하는 과학기술을 반영하기 위한 용어의 변경 등의 방법으로 개정을 제안하였다.

The introduction and use of smart corrections is emerging as an alternative to solving problems such as correctional officers’ work over-load, correctional facilities overcrowding, and human rights violations. However, in order to introduce and utilize the concept of smart corrections in the correctional field, there are legal issues that must be resolved. Therefore, the purpose of this study is to discuss key issues related to smart corrections and analyze relevant laws, and based on this, present basic legal alternatives for the introduction of smart corrections and application to correctional facilities. To achieve the purpose of this study, legal problems for the introduction of smart corrections were analyzed by checking the legal environment related to smart corrections, major laws, and major recommendations of the National Human Rights Commission of Korea. In order to introduce mobile CCTV and smart bands, methods such as unification of the enforcement rules of laws such as the 「ADMINISTRATION AND TREATMENT OF CORRECTIONAL INSTITUTION INMATES ACT」 and the ENFORCEMENT RULE of the same ACT with related laws and terminology to reflect the rapidly developing science and technology, etc. was proposed to be amended.
