A Study on the Factors of the Dismission with a Caution in the Korean Police Diversion System

Nowadays the problem of a juvenile delinquency appears a social question which is serious from all parts of the world, though each nation has a surround- ings and customs. Of course South Korea is no exception. This is a thesis to find out the structural problem of the delinquency control system in the juvenile judicial system and to try to improve it, and to study on the factors of the dismission a juvenile delinquent with a caution in the police diversion system. The reason why the problem of a juvenile delinquency is recognized pro- foundly to the whole world is quantitative increase, a generation, a low-age, an collectivelization, a drugs-crime increase, a violence increase in the home or school, an increase of a second offense rate and etc. of that. Accordingly it is important that we prevent a juvenile delinquent from wrongdoing. A matter of primary concern on a juvenile delinquency will come to the conclusion that we can do what to preserve a juvenile delinquency and the factors of the dismission a juvenile delinquent with a caution in the police diversion system. The police-step in sections the juvenile justice system are taking a criminal case and the dismission. The dismission step are classified into conditionally or unconditionally. The factors of the dismission in the police diversion system are classified a juvenile delinquent, a victim, a dismissor, a wrongdoing s parents and the fact itself. The result of this analysis that a diversion system have merits and demerits. The merits of diversion system is educative in treatment and economical from the justice burden point of view and avoidable from labelling effect and reductive in second offence. In conclusion, The first thing we must be interested in the juvenile delinquency. In juvenile justice system we must accept strength of diversion and develop diversion program. Finally, The purpose of juvenile justice and guarantee of human rights can realize the dismission a juvenile delinquent with a caution in the police diversion system.
