The Historical Continuity of Preventive Custody Right After May 16 Coup

불법 연행과 구금을 기본으로 하는 예비검속은 한국 현대사에서 여러 차례반복·재현되었는데, 특히 한국전쟁기 예비검속은 단순한 구금에 그치지 않고집단학살로 이어졌다. 전쟁을 전후해 예비검속에 관여한 군·검·경 정보기구의사찰을 중심으로 한 기능은 갈수록 강화되었다. 숙군과 부역자 처벌, 예비검속을 거치면서 이들 기관의 공조 경험도 축적되었다. 5·16 직후 쿠데타 주도세력은 ‘용공분자’ 소탕을 앞세워 대규모 예비검속을단행하였다. 한국전쟁 때와 마찬가지로 비상계엄이 선포되고 경찰 사찰계통과군 방첩대가 대상자들에 대한 불법 연행과 구금에 나서는 일이 다시 반복된것이다. 이때는 지속적인 사찰로 축적된 자료와 명부의 존재, 군·검·경의 공조경험 등으로 좀 더 신속하고 체계적으로 진행되었다. 한국전쟁 때 예비검속의 경험과 반복적인 군검경의 공조 경험, ‘요시찰인’, ‘위험인물’ 명부의 존재와 국가 정보기구의 사찰, 이 모든 것은 우리 현대사에서 불법적인 예비검속의 반복을 가능하게 한 역사적 유산이었다.

Preventive custody whose basic elements were illegal arrests and illegal detentions was repeated many times in the modern history of Korea. Like during the Korean War, an emergency martial law was declared with the inspection lines of the police and the counter intelligence corps of the military taking the lead in illegal arrests and illegal detentions once again. This time saw more speed and system based on the accumulated materials through continuous inspections, the presence of lists, and cooperation experiences among the military, the prosecution, and the police. The historical heritage including the preventive custody experiences during the Korean War, repeated cooperation experiences among the military, the prosecution, and the police, the presence of the lists of ‘people under surveillance’ and ‘dangerous characters,’ and inspection by the national intelligence agency made illegal preventive custody possible again and again in the modern history of Korea.
