A Study on Legal Struggles with Naturalized Koreans in Japan: Focusing on the Newsletter “Our Name”

This paper attempted to explore the contemporary meaning of the legal struggle over naturalized Koreans in Japan, focusing on Our Name, a bulletin of the “Group to Recapture National Name”, which was formed around 1980 when generational changes and subsequent settlement consciousness began to work. In particular, we tried to analyze the process of establishing the national identity of naturalized Koreans in Japan, who have been seeking a way of coexistence rather than being fully assimilated, and what problems arise in allowing the use of “National Name” for minor children. As a result, naturalized Koreans in Japan formed a discourse of naturalized Koreans as a “right” rather than a “National Name” through legal struggles, but minor children often use their real names for parental wills and recommendations, and as a result, they are forced to face the reality of weak children’s will. In addition, it can be seen that there were cases where national identity was forced according to the will of parents, such as the division of identity of children in Japan outside of schools where human rights education is not properly conducted and the Korean community in Japan.

本稿では、1980年前後に起きた在日朝鮮人の世代交代とそれに伴う定住意識が強く働き始めた時期に結成された「民族名を取り戻す会」の会報『ウリイルム』を中心に、帰化在日朝鮮人をめぐる法的闘争の同時代的意味を考察することを目的とした。特に、日本に完全同化するよりは差異を作りながら共存の在り方を模索してきた帰化在日朝鮮人の民族的アイデンティティ確立のプロセスと、未成年の子ども世代に「民族名」を名乗らせることの意味を同時代に展開された「本名を呼び名乗る運動」との関係性の中で問ってみた。 その結果、帰化在日朝鮮人は法的闘争を通して、「同和」ではなく「権利」 としての帰化在日朝鮮人の議論を展開していったが、未成年の子ども世代の場合は親の意志や勧誘で本名を名乗る場合が多く、これは結果的に差別を容易に克服できない「弱い人間」に対する配慮と子ども世代が経験せざるを得ない現実的な問題には背を向けたまま、親世代の意志によって民族的アイデンティティを強いられることになるプロセスを明らかにした。
