사회과에서 법교육과 인권교육의 방향성 연구

A Study on the Direction of Law-related Education and Human Rights Education in Social Studies

연구목적 이 글은 사회과에서 법교육과 인권교육이 공존하여 발생하는 문제점을 파악하고 개선 방안을제안하는 것을 목적으로 한다. 연구방법 이러한 목적을 달성하기 위하여 먼저 사회과 교육에서 법교육과 인권교육의 발전 과정을 파악하였다(II). 그리고 2015 개정 교육과정에서 법교육과 인권교육이 충돌하여 발생하는 문제점을 분석하고(III),권리 교육을 중심으로 법교육과 인권교육의 관계 재정립 방안을 제시하였다(IV). 마지막으로 이상의 논의를정리하며 법교육과 인권교육의 방향을 제안하였다(V). 연구결과 사회과 교육에서 법교육과 인권교육의 간섭현상을 문제점으로 지적하고 원인을 분석하여 대안을제안하였다. 결론 법교육과 인권교육의 충돌 원인으로는 교육과정에서의 권리 개념의 부재, 교육과정에서 법교육과인권교육의 범위에 대한 합의 부재를 들었다. 이에 대한 대안으로 첫째, 권리 교육 단원의 신설, 둘째인권의 재개념화, 셋째 법교육과 인권교육의 목표와 범위 조정을 제안하였다.

Purpose: The purpose of this article is to identify problems arising from the coexistence of Law-relatedEducation and Human Rights Education in Social Studies and to propose improvement measures. Methods: In order to achieve this purpose, first, the development process of Law-related Educationand Human Rights Education in Social Studies Education was identified (II). In addition, the problemsarising from the conflict between Law-related Education and Human Rights Education in the 2015 revisedcurriculum were analyzed (III), and a plan to re-establish the relationship between Law-related Educationand Human Rights Education was proposed (IV). Finally, the above discussions were summarizedand the direction of Law-related Education and Human Rights Education was proposed (V). Results: In Social Studies Education, the interference phenomenon between Law-related Educationand Human Rights Education was identified as a problem and the cause was analyzed to proposean alternative. Conclusion: The reasons for the conflict between Law-related Education and Human Rights Educationwere the lack of the concept of rights in the curriculum, and the lack of consensus on the scopeof Law-related Education and Human Rights Education in the curriculum. As an alternative to this,first, the establishment of a rights education unit, second, reconceptualization of Human Rights, andthird, adjustment of the goals and scope of Law-related Education and Human Rights Education wereproposed.
