유･도선 음주조종에 관한 몇 가지 문제점

유선및도선사업법에서 음주조종을 금지해야 하는 이유는 음주로 인해 조종능력을 저하시켜서, 조종하는 자뿐만 아니라 타인의 생명･신체･재산 등에 중대한 침해를 가할 위험성이 크기 때문이다. 따라서 유선 및 도선 음주조종을 금지하고 이를 위반한 경우에는 형사처벌을 하도록 해사안전법 그리고 유･도선법에서 규정하고 있다. 해사안전법에서 해상에서 사용되는 유선 및 도선을 포함한 선박에 대하여 음주조종을 금지하고 있다. 해사안전법은 해상항행선박이 항행할 수 있는 곳에서는 적용되기 때문에 해사안전법이 적용되지 않는 곳에서만 유･도선법으로 보완하는 것이다. 그렇다면 유선 및 도선 음주조종은 장소에 상관없이 동일한 형벌을 부과하도록 규정하는 방식으로 개정하는 것이 타당하다고 사료된다. 그렇다면 유선및도선사업법상 음주조종죄의 주체를 신분범으로 규정할 것이 아니라 일반범으로 규정해야 하고 유선및도선사업법상 음주조종에 대한 처벌규정을 해사안전법과 동일하게 혈중알콜농도에 따라 처벌하도록 개정해야 할 것이다.

If so, it is considered reasonable to revise the The Excursion Ship Business And Perry Business Drinking Control in a way that stipulates that the same punishment is imposed regardless of place. If so, the Excursion Ship Business And Perry Business should be subject to criminal punishment for anyone who controls alcohol, and the law should be revised to punish alcohol in the blood according to the same level as the Maritime Safety Act.
