조선 초기 정도전(鄭道傳)의 법전(法典) 편찬과 주례(周禮) 이념

Codification and Zhouli Ideology of Jeong Dojeon in Early Joseon

이 논문은 조선 초기 정도전(鄭道傳)의 법전 편찬과 법전에 나타난 주례이념(周禮理念)을 고찰한 글이다. 정도전은 조선왕조 개국의 최고 공신이자 조선조 500년의 기틀을 다진 인물로, 건국이념은 물론 관료체제에 이르기까지 온전히 그의 손에 의해 이루어졌다. 정도전은 조선이 건국된 2년 후인 1394년 조선의 통치 조직을 확립하고자 『조선경국전(朝鮮經國典)』을 찬진하였다. 육전(六典) 체제는 천·지·춘·하·추·동 육관(六官)으로 된 『주례(周禮)』를 이상적인 국가례(國家禮)로 여겨 동아시아의 정치제도에 막강한 영향을 끼쳤다. 『주례』의 국가례는 천·지(天地)와 춘·하·추·동(春夏秋冬)의 자연 질서를 인간 사회에 구현한 것이다. 『조선경국전』은 천인합일(天人合一) 사상을 바탕으로 인정론(仁政論), 총재정치론, 육전 체제 등 『주례』의 이념을 반영한 것이다. 그러나 『조선경국전』은 완비된 법전이 아니라 법전에 담아야 할 이념과 방향을 제시한 지침서로 이후 『경제육전(經濟六典)』 및 『경국대전(經國大典)』 편찬에 지대한 영향을 끼쳤다.

This paper is to examine Zhouli(周禮, national rituals) ideology indicated on codification and corpus juris of Jeong Dojeon in early Joseon. Jeong Dojeon is the most prominent founding contributor of Joseon Dynasty and he established the foundation of 500-year-long Joseon period. Not only the ideology of Joseon foundation but the bureaucracy was formed completely with his own hands. He wrote 『Joseongyeonggukjeon』 in order to establish Joseon’s ruling organization to be served as norms for eternity and rendered it to King in 1394(the 3rd year of King Taejo). As everyone knows, Gyeongjeyukjeon system regards 『Zhouli』 of six categories with Heaven·Earth·Spring·Summer· Fall·Winter as the ideal national rituals, which is a classification scheme that forms the backbone of pre-modern Chinese governance and corpus juris. It had significant impact on administration and political systems of all time. The notion of unity between nature and human that tried to realize the natural order of Heaven· arth·pring·Summer·Fall·Winter in 『Zhouli』; benevolent governance theory with the property of benevolence(仁); governor politics theory that stressed publicness of politics and; Gyeongjeyukjeon system are all reflection of 『Zhouli』 ideology. However, 『Joseongyeonggukjeon』 is not a thorough version of corpus juris but a guideline that suggests ideology and future direction of Joseon law, which later served as a guide for publishing 『Gyeongjeyukjeon(經濟六典)』 and 『Gyeonggukdaejeon(經國大典)』.
