고려 공양왕대 신율(新律) 찬진(撰進)의 정치적 의미

Political Meaning of the Compilation of Sinyul during the Reign of King Gongyang of Goryeo

본 글은 고려 공양왕대 신율이 찬진되었던 배경을 살펴보고 실제 사용된 상황을 검토하여 신율 찬진의 정치적 의미를 밝혔다. 고려 말에는 원율, 『대명률』 등 다양한 율이 수용되면서 고려 법령과 함께 사용되었다. 이에 따라 고려의 상황에 맞는 하나의 율(律)로 통일하려는 움직임이 나타났고 그 결과물 중 하나가 신율이었다. 아울러 신율 찬진을 공양왕대 정국과 연결시켜 살펴보았다. 이성계 세력이 반대 세력을 제거하기 위해 활용하였던 5죄의 처리 과정에서 형정 개혁의 필요성이 부각되었다. 또한 신율을 편찬함으로써 이성계 세력에 대한 견제도 이루어졌다. 이것이 확인되는 부분이 모반 무고에 대한 처벌이었다. 신율 찬진 이전의 모반 무고 처벌과 달리 신율 찬진 이후에는 수범과 종범을 나누지 않고 극형에 처했고, 연좌 범위도 넓어졌다. 정몽주는 신율을 통해 정도전, 조준을 제거하고자 하였으나 결국 피살되면서 실패하게 된다. 이후 이성계 세력은 공양왕으로부터 신율에 근거한 처벌권을 빼앗으면서 신율 편찬 이후 있었던 위협을 차단하였다.

This study examined the background of the compilation of the Sinyul during the reign of King Gongyang of Goryeo and reviewed the actual situation used to reveal the meaning of Sinyul compilation. At the end of the Goryeo Dynasty, various code such as Wonyul and Táminglǜ were accepted and applied together with the Goryeo code. Accordingly, a movement to unify with one code appeared, and one of the results was Sinyul. Therefore, we looked at it in connection with the political situation of King Gongyang. The need for penal administration reform was highlighted in the process of dealing with the five crimes used by Yi Seong-gye’s party to eliminate opposition party. In addition, the intention to check the Yi Seong-gye’s party was partially reflected in Sinyul. What this was confirmed was the punishment for the false accusation of rebellion. Unlike the punishment of false accusation before Sinyul compilation, after Sinyul compilation, everyone is sentenced to death, and the scope of involvement expanded. Jeong Mong-ju tried to eliminate Jeong Do-jeon and Jo Joon through Sinyul, but eventually failed as he was killed. Since then, Yi Seong-gye’s party have taken away the right to punish based on Sinyul from King Gongyang and blocked Jeong Mong-ju’s attempts to check opposition party through the Sinyul.
