아이슬란드의 마약류사범 갱생보호제도 연구

Review on the Rehabilitation System for Drug Offenders in Iceland

국내에서는 마약류사범에 대한 형사적 처벌보다 치료의 개념으로 그들을 지원하고 관리해야 된다는 이념의 중요성이 인식되어, 치료보호제도나 치료명령제도와 같은 방안으로 마약류사범에 대한 처우가 이루어지고 있다. 하지만 마약범죄 발생과 재범률은 점점 증가하는 추세로, 이는 국내에서 현행되고 있는 마약류사범 처우에 문제점이 존재하며 이의 개선이 필요하다는 것을 보여준다. 그러므로 이에 대한 개선방안을 논의하기 위해 마약사범 교정 복지선진국인 아이슬란드의 사례를 연구하고, 이를 국내 사례와 비교 분석하였다. 아이슬란드의 경우, 마약범죄 출소자에 대해 일반복지개념의 갱생보호서비스를 제공하고 이를 위한 지역사회기관의 협력을 권고하고 장려하는 정책을 시행하고 있다. 아이슬란드 정부의 출소자지원에 대한 관심과 지원을 바탕으로 중독문제를 가지고 있는 출소자는 체계적이고 전문적인, 그리고 지속적인 치료와 보호조치를 제공받을 수 있다. 하지만, 국내의 경우 마약범죄 출소자 지원체계에 많은 허점이 존재하였고 이에는 예산부족, 전문인력 부족, 단계적 및 체계적 치료프로그램 부재, 후속관리 부재 등이 해당된다. 이에 대한 개선방안으로 본 연구는 사회 내 재범방지 중추기관인 한국법무보호복지공단(이하 ‘공단’)을 중심으로 마약범죄 출소자 대상 일반복지개념의 교정 복지서비스 제공의 필요성을 제시하였다. 즉 공단을 중심으로 마약범죄 출소자 갱생보호제도를 홍보하고, 대상자 후속관리를 제공하며, 지역사회 복지서비스제공기관과의 연계체계를 마련하는 것이다. 약물 남용문제를 한 기관에서 효율적으로 관리하여 이로 인한 사회적 문제와 범죄피해를 효과적으로 억제할 것으로 기대되며, 이를 위한 사회적 관심과 정부의 정책적 지원이 필요한 것으로 보인다.

In Korea, the importance of the ideology of supporting and managing the concept of treatment rather than criminal punishment for drug offenders is recognized, and drug offenders are treated in the same way as treatment protection and treatment order systems. However, the incidence and recidivism rate of drug crimes are on the rise, which shows that probability there are problems with the treatment of drug offenders in Korea, so improvement is necessary. Therefore, in order to discuss improvement measures, the case of Iceland, an advanced country in drug offenders correctional welfare, was studied and compared with domestic cases. In the case of Iceland, policies are being implemented to provide rehabilitation protection services under the concept of the general welfare to released drug offenders and to recommend and encourage cooperation from community agencies. Based on the government’s interest and support for rehabilitation support, released prisoner, released prisoners who have an addiction and mental illness problems can be provided with systematic, professional, and continuous treatment and protection measures. However, in Korea, there were many problems in the released drug offender support system, including lack of budget, lack of professionals, absence of phased and systematic treatment programs, and absence of follow-up management. To solve the problem, this study suggested the need to provide general correctional welfare services to drug offenders, centering on the Korea Rehabilitation Agency(‘Gongdan’), the central organization for preventing recidivism in society. With the Korea Rehabilitation Agency at the center, it is expected to effectively curb social problems and criminal damage caused by drug abuse by promoting the rehabilitation service for released prisoners and released drug offenders, providing released criminal follow-up management, and establishing a linkage system with the community welfare service providers.
