수형자의 능동적 사회복귀 정책에 관한 연구

현재 시행되고 있는 제도들은 모두 교정 당국에 의해 수동적으로 수형자의 사회복귀를 촉진하는 제도로 평가받고 있다. 이 때문에 수형자 사회복귀의 동기 부여 측면에서 보면 수형자의 자발성이 부족하다는 문제의식이 항상 제기되어 왔었다. 한국의 교정현실은 안타깝게도 이 문제에 대한 해법을 제시하기는 커녕 아직도 걸음마 단계에 머물고 있는 실정이다. 이러한 비판을 잠재울만한 획기적인 제도가 미국 뉴욕에서 시작되었는데, 이른바 “Good Time credit” 또는 “Good Time System”의 시행이다. 대부분의 국가에서 앞 다투어 보편적으로 시행되는 이 제도는 우리나라에서는 형기 자기 단축제도, 선행보상제도, 선시제도, 선행감형제도 등과 같이 다양한 용어로 혼재되어 사용하고 있다. 그렇지만, 통일적이고 공식적인 개념 정립은 이루어지지 않고 있었다. 그럼에도 불구하고 각국이 본 제도를 수용하여 시행하고 있는 이유 가운데 가장 큰 특징은 수형자가 스스로 사회에 복귀하기 위해 자발적으로 노력하는 자세와 동기를 부여한다는데 있다. 수형자는 모범적인 수형생활 및 사회복귀 촉진을 도모할 수 있기 때문에 안정적이고 모범적인 수형생활로 인해 수용질서 확립에 기여할 수 있는 장점이 있다. 또한 교정당국은 불확정적인 가석방 결정과 달리 교도작업, 교육훈련, 규율준수 등을 통해 수형자 스스로 형기를 단축시키기 때문에 교정정책의 효과성을 제고할 수 있다. 따라서 이 연구에서는 “Good Time System” 제도의 도입가능성과 그 한계 측면에서 접근을 시도하고자 한다.

Self-reducement of prison term system for good-time prisoners has not been seriously studied except for the discussion in sentence execution practice area with the topic of good time for an alternative system of parole. In Korea, there remains a brief record in which the United States Military Government authorities tried to implement a good time system but no detailed document of how they run it and what was the real effect. Instead, Korean legal system has adopted the parole system with various measures for better treatment of prisoners. A self-reducement of prison term system for good-time prisoner can resolve the problem of long-lasting prison overcrowding and encourage prisoners to follow rules and regulations and thus enhance their rehabilitation. To introduce good time system into Korea, what is a better form of enforcing a system should be taken into consideration based on the perspectives of criminology, criminal justice, execution of sentence, administrative laws, etc. The parole should be used side by side with good time based on the viewpoint of human dignity. In fact, a parole system is run based on the considerations of recidivism to enhance a possibility of future law-abiding life-style. Therefore, based on a parole system, a prisoner is placed from imprisonment to inner social treatment. In contrast, a good time system has a different approach about a factor of recidivism, because a prison himself or herself can try to reduce prison terms with his or her own efforts and thus voluntarily enhance rehabilitation. After analyzing a good time system, the United States and France is running good time system by giving good time credits to a prisoner. China also adopts good time system with his own style. Japan also has run a system of parole which is similar to Korea but has discussed a lot about good time system. This paper is proposing the introduction of good time system into Korea, by analyzing theoretical aspect of good time system and comparative studies of leading countries’s system. In addition, this paper tries to suggest a better form of good time system, with respect to acceptable and objective standards of calculating actual prison term, a scope of beneficiary, policies to effective rehabilitate a prisoner, a discretion of a correction office.
