미국 해상보험법상 연방법과 주법의 적용에 대한 구조적 문제점에 관한 고찰

A Study on Structural Problems in the Application of Federal and State Laws in the US Marine Insurance Law

Wilburn Boat 사건에 의해 해상보험 분쟁사건의 적용법에 주법의 선택을 시사한 판례법이 탄생한 이후 주법상의 비해상 판례법과 제정법도 상황에 따라 해상보험법을 충족할 수 있게 되었다. Travelers v. Ocean Reef 사건에서 지방법원은 해상보험증권상 연방해사법을 엄격하게 적용해야 하기 때문에, 보험증권하에서 요트의 손해에 대해 보험금을 지급할 책임이 없다고 판결하였다. 그런데 제11순회구 연방항소법원은 선장 또는 해원의 담보특약에 적용되는 해사법원칙이 확립되어 있지 않아, 피보험자의 담보특약 위반의 영향을 결정함에 있어 결과적으로 플로리다법이 적용되어야 한다고 하여 지방법원의 판결을 번복하였다. 이와 같이 미국은 복잡한 법원칙이나 독특한 소송관행이 있으며 해상보험법도 그 환경 하에 있다. 본 연구에서는 미국 해상보험법에 내재하는 문제로서 해상보험계약에 관한 준거법 선택과 관련된 문제를 분석한다. 이와 관련하여 영미법의 일반적인 특징으로서 문제의 근원이 된 판례나 그 후의 판례법의 형성에 대한 분석을 한 후 이를 바탕으로 미국법의 독특한 구조상의 문제점과 해결책을 분석한다.

Purpose : The purpose of this study analyses the structural issues in the application of Federal and State laws in the US Marine Insurance Law. Research design, data and methodology : The methodology is a typical case law analysis dealing with the issues surrounding the selection of the applicable law for marine insurance contracts as the issues implied by the US Marine Insurance Law. Results : In Travelers v. Ocean Reef, the 11th Circuit Federal Court of Appeals stated that only the Supreme Court had the privilege of overturning its decision and, unlike some commentators, could not dismiss Wilburn Boat on the grounds that it might disagree with Wilburn Boat. In Travelers v. Ocean Reef, will prove fascinating enough to tell you what the Supreme Court thinks about Wilburn Boat today. Conclusions : Considering the possibility that the law of the United States, which is popularly referred to as a major power in litigation, will affect Korea's trade officials, it is even more so. In addition, although the problem of the marine insurance law in the United States is recognized as a domestic problem, it should be recognized that the effect of opacity of the law and the diversification of legal principles is international.
