직장 내 성희롱 피해자의 2차 피해 실태 및 대응방안에 관한 연구

A Study on the Current Status of Second-order sexual harassment and Countermeasures of Sexual harassment Victims

과거와 달리 미투(Metoo)운동의 영향으로 성희롱 피해에 적극 대응하는 등 사회적 변화가 이루어지고 있으나 직장 내 성희롱 사건의 경우 소속기관의 부적절한 대응과 사건 은폐 등 가해자에 대한 처벌은 소극적으로 이루어져 도리어 사건화 한 것에 대한 후회나 사건 진행을 중도 포기하는 사례가 빈번하게 나타나 문제가 되고 있다. 이 연구는 직장 내 성희롱 사건에 대한 2차 피해에 대한 이해를 높이고, 법률과 정책적 대응방안이 실효성을 가질 수 있도록 실제 피해자와의 인터뷰를 통해 직장 내 성희롱 발생 후 겪게 되는 2차 피해에 대한 문제 상황을 분석하였다. 그 결과 2차 피해 문제에 대한 대응방안에 대하여 첫째, 조직 내부적 차원에서는 ① 가해자 징계의 확실성 보장 ② 피해자 보호 및 지원 강화 ③ 조직문화 개선 ④ 2차 피해 지침 마련과 공지 ⑤ 고충처리부서와 고충처리담당인력의 전문성 함양 ⑥ 연계시스템 구축을 둘째, 조직 외부적 차원에서는 ① 언론보도에 의한 2차 피해 방지를 위한 제도 수립 ② 외부기관의 모니터링으로 제안하였다. 이 연구를 통해 향후 피해자 보호에 대한 실질적 대응에 도움이 되길 기대하며, 이 연구는 대응방안 발전을 위해 후속 연구들의 토대연구로 2차 피해에 대한 이슈를 재조명하는데 의의를 둔다.

Due to the influence of the Me Too movement, social changes are actively responding to sexual harassment. However, sexual harassment cases in the workplace are passive in punishing the perpetrator due to inappropriate responses from their agencies and concealment of the case. In addition, there are frequent second-order sexual harassment happened to victims and those who give an active help in favor of victims. In turn, victims regret about reporting their case into the case and give up the progress of their case in the middle. This study aims to analyze second-order sexual harassment through interviews with sexual harassment victims in the workplace and present effective and efficient legal and policy countermeasures. As for the countermeasures against second-order sexual harassment in the internal level of organization, ①ensuring the punishment of perpetrators in the organization, ⓶strengthen the protection and support of victims, ③improvement of gender equality organizational culture, ④ development of professionalism of the grievance manager, ⑥establishment of linkage system for grievance. And at the external level of the organization, ①the establishment of a system to prevent second-order sexual harassment caused by media press, ②the monitoring of external institutions are proposed. This study will help in practical response to the protection of sexual harassment victim in the future, and this study is meaningful in re-examining the issue of second-order sexual harassment as a foundation study of follow-up studies for the development of countermeasures.
