ICT 관련 첨단기술을 이용한 범죄에 대한 각국의 규제 현황

Status of Regulations in Major Countries on Crimes Using Advanced Technologies Related to ICT

정보통신기술(Information and Communication Technologies, ICT)은 디지털 기반의 새로운 제품이나 서비스가 출시될 수 있도록 하는데, 이른바 4차 산업혁명을 선도하는 첨단기술도 ICT의 발전을 기반으로 한다. 첨단기술의 대명사격인인공지능과 그 기술이 응용된 자율주행자동차나 드론, 연결망의 확대 및 보안강화라는 측면에서 네트워크 혁신을 이끌고 있는 사물인터넷과 암호화·익명화 기술, 디지털 세계와 물리적 세계의 융합을 견인하고 있는 확장현실과 디지털 제조 기술 등은모두 ICT를 토대로 하는 것이다. ICT 관련 첨단기술은 인간의 삶을 한층 더 편리하고 풍요롭게 만들지만, 해당 기술이 범죄에 악용될 때에는 사회의 안녕과 질서유지에 위협이 될 수 있다. 이에 국가는 첨단기술을 이용한 범죄에 대응하고자 규제 법률을 마련하기도 하나, 그 조치가 신속하게 이루어지지 못할 경우에는 법익침해적인결과가 야기되더라도 입법적 미비로 인해 처벌할 수 없는 상황이 벌어진다. 오늘날기술의 발전과 관련 입법의 속도 간 격차는 빠르게 좁혀지고 있다. 이에 본고는 첨단기술을 이용한 범죄에 대한 적절한 규제가 이루어질 수 있도록 범죄의 유형 및 그에대한 주요 국가들의 규제 현황을 살펴보고, 우리나라의 입법 현황을 파악한 후 그 개선 방안을 제언하였다.

Information and communication technologies enable new digital-based products or services to be launched. The advanced technologies leading the 4th industrial revolution are also based on the development of ICT. Artificial intelligence which is synonymous with cutting-edge technology, autonomous vehicles and drones to which the technology is applied, internet of things and encryption/anonymization technologies, that are leading network innovation in terms of network expansion and security enhancement, and extended reality and digital manufacturing technology, which are leading the convergence of the digital world and the physical world, are all based on ICT. The development of high technology can make human life more convenient and affluent, but if the technology is abused for crime, it can threaten the safety of society and maintaining order. The state may prepare laws to regulate crimes using advanced technology, but if the measures are not taken promptly, even if there is a result infringing on the interests of the law, the perpetrators cannot be punished because there are no regulations. Today, the gap between the development of technology and the speed of related legislation is rapidly narrowing. This paper examines the types of crimes and the regulatory status of major countries for them so that appropriate regulations can be made on crimes using advanced technology, and suggests improvement plans after checking the current state of legislation in Korea.
