양형기준에 있어서 자유형·벌금형 선택 기준

현행 양형기준은 징역형과 벌금형이 선택형일 경우 형종 선택에 대한 양형기준을설정하고 있지 않다. 그 이유는 형종 선택에 대한 양형기준 설정을 위해 필요한 다양한 선결조건이 해결되지 않았기 때문이다. 본 연구에서 형의 경중과 형벌효과의 동등성 측면에서 자유형과 벌금형이 동등하지 않다는 점, 법정형에서 징역형과 벌금형이 비례적 관계에 있지 않다는 점, 형종 선택 기준에 대한 입법이 없기 때문에 양형기준에서는 처단형 단계에서 형종 선택이 되는 것이 아니라 선고형 단계에서 형종 선택이 된다는 점, 벌금형이 선택형뿐만 아니라 병과형이 있다는 점 등이 형종 선택 기준을 설정하는데 어려움을 주고 있다고 분석하였다. 현행 양형기준은 선거범죄를 제외하고 징역형에 관해서만 형량 산정의 기준을 제시하고 있고, 형종 선택 및 벌금형 형량 산정 기준 제시가 없기에 양형실무에서 벌금형 양형기준의 설정을 요청하고 있고, 양형위원회는 이를 준비하고 있다. 본 연구에서는 형종 선택 기준을 위한 이론적 모델을 제시하였다. ‘양형과정에서형종 선택 기준을 어느 단계에서 적용할 수 있는가’에 따라서, 현행 선거범죄의 벌금형 양형기준과 같이 ‘권고영역이 결정된 후 형종 선택을 하는 방식’과 ‘범죄유형이 결정된 후 형종 선택을 하는 방식’이 가능할 것으로 생각하며, 경우에 따라서는 양자를적절히 혼합하는 모델도 가능하리라 생각한다. 각 방법에 대한 설명과 장·단점, 기준설정을 위한 검토를 하였다. 특히 형종 선택을 위한 공통 기준과 형종 선택을 위한 양형인자 신설에 대하여 집중적으로 검토를 하였다. 형종 선택의 기준은 징역형과 벌금형 중 어느 형종을 선택할 것인가를 고민하는 법관들에게 유용한 자료가 될 수 있기를 희망한다.

The current sentencing standards do not set the sentencing standards for fines. Due to the lack of sentencing standards for fines, problems such as imbalance and unfairness of sentencing and lack of predictability of sentencing are occurring. This paper presents a basic model for the penalty sentencing criteria. This paper presents a model (1 model) for selecting the recommended area after determining the recommended area and a model (2 model) for determining the recommended area after selecting the type. After reviewing the model for selecting the type, it was proposed as follows. It is reasonable to apply the fine sentencing standard only when the fine is legal as an optional sentence, and it is reasonable not to apply the fine sentencing standard if the fine is a combination sentence. The common principle of type selection needs to be set as a standard that can be applied not only to individual crime groups but also to all crime groups. Selection factors for selection of types from individual crime groups should be extracted.
