어린이집 원장의 아동학대 신고의무자 역할수행 경험 탐색

Exploring the Experience of the Daycare Center Director's Role as a Mandatory Reporter for Child Abuse and Neglect

목적 본 연구에서는 어린이집 원장들이 아동학대 신고의무자 역할을 경험하며 갖게 된 역할 인식, 실제 대응, 요구사항에 대해 심층적으로 살펴보고자 하였다. 방법 어린이집을 운영하는 과정에서 아동학대 신고에 대한 법적 의무가 있는 어린이집 원장 6명을 대상으로 각 2회씩 심층면담하고 필요한 경우 대면 및 전화면담을 1회~2회 더 수행하였다. 수집한 자료는 ‘개방코딩’, ‘범주화’, ‘범주 확인’ 과정을 거치며 질적분석하였다. 결과 어린이집 원장들은 아동학대 신고의무자의 역할수행에 대해 당연히 수행해야 하는 역할, 두려움이 동반되는 역할, 관계로 인해 고민되는 역할, 직무에 다른 입장 차가 있기도 한 역할로 인식하였다. 아동학대 신고 관련한 실제적 대응은 즉각적인 신고보다는 민감한 관찰과 확인하기, 신고보다는 직⋅간접적 경고하기, 신고 관련 갈등 중재하기, 신중한 신고와 책임지기와 같은 방법인 것으로 나타났다. 아동학대 신고의무자 역할을 더 잘하기 위해서는 아동학대 신고의무자 교육의 개선, 신고 관련자 및 기관 보호, 신고에 대한 시각 개선이 무엇보다 필요하다 하였다. 결론 어린이집 원장에게 아동학대 신고의무자의 역할이란 원장이라는 직무에 맡게 고려해야 할 점이 있는 역할로 인식되고 있었었다. 이에 실제 법에 명시된 대로 즉각 신고하기보다는 나름의 대처 방법을 우선하고 있었다. 또한 원장으로서 신고의무자 역할수행을 잘 수행하기 위해 다각적 개선을 요구하였다. 이러한 본 연구결과는 아동학대 신고의무자로서의 어린이집 원장의 입장과 경험을 이해할 수 있는 기초자료를 제공하여 추후 직무특성을 반영한 효율적 신고의무자 역할 방안을 마련하는데 밑거름이 될 것이다.

Objectives The purpose of this study was to explore perceptions, actual responses, and demands of child care center directors as a mandatory reporter for child abuse and neglect. Methods Six directors of child care center, which are legally obligated to report child abuse and neglect, were interviewed twice each. If it needs more information, one or two additional interviews were conducted by telephone or in person. A qualitative research method was used for analysis. Results Directors’ perceptions about a mandatory reporter for child abuse and neglect were as follows: recognized as a role that (1) should be performed by obligation, (2) is accompanied by fear, (3) is troubled by a relationship, and (4) is a difference of position in the job. The actual response to the mandatory reporting of child abuse and neglect was classified into (1) observing and confirming more sensitively than an immediate report, (2) giving a direct or indirect warning rather than a report, (3) mediating conflicts related to the report, and (3) taking responsibility after careful reporting. To develop ability as a mandatory reporter for child abuse and neglect, directors’ demands were as follows: (1) improvement of education for directors obligated to report child abuse and neglect, (2) protection of reporting persons and daycare center, and (3) improvement of perspective on reporting of Child abuse and Neglect. Conclusions The director of the daycare center recognized that there were things to consider as a director when taking on the role of a mandatory reporter to report child abuse and neglect. Therefore, rather than reporting immediately as specified in the actual law, they prioritized their own countermeasures. In addition, in order to fulfill the role of reporting duty as the director of child care center, various improvements were requested. The results of this study will provide basic data to understand the experience of the director of a daycare center as a person obligated to report child abuse, and will be helpful preparing an effective plan for the role of a report duty officer reflecting the characteristics.
