파생금융상품 양도차익 소득과세에 관한 문제점 및 개선방안

The Problems and Improvement Direction on Income Taxation on Capital Gain of Financial Derivatives

2014년은 파생상품 거래에 따른 거래세 부과와 파생상품 양도차익에 대한 소득세 부과에 대하여 뜨거운 논쟁이 있었고 결국 파생상품 양도차익에 대한 소득세를 부과하는 것으로 법이 개정되었다. 2016년부터 파생상품 양도차익에 대하여 소득세가 부과됨에 따라 파생상품 금융시장의 장기 침체가 예상되고 있어 현물시장뿐만 아니라 파생금융상품 시장의 활성화를 기대하기에는 어려운 상황에 처해있다. 본 연구는 이와 같은 상황을 감안하여 현물시장에 대한 증권거래세 부과 및 2016년부터 과세예정인 선물시장의 파생상품 양도차익에 대한 소득세 부과에 관한 문제점과 법 개정에 대한 평가를 해보고 이를 통하여 향후 파생금융상품뿐만 아니라 현물시장의 활성화를 위한 개선방안을 제시해 보았다. 본 연구에서는 파생상품 양도차익 과세와 관련하여 다음과 같이 주장하고자 한다. 우선, 향후 현물거래에 대한 증권거래세 및 선물에 대한 파생상품 소득세 과세에 대한 과세체계의 법령 정비가 필요하다. 둘째, 파생상품 양도차익에 대한 손실에 대하여 이월공제를 허용할 필요가 있다. 셋째, 파생상품 양도차익 과세시행에 앞서 과세대상과 세율 등의 세부적인 사항에 대하여 세부담이 최소화 되도록 개정할 필요가 있다. 넷째, 파생상품에 관한 소득세 부과는 현물의 주식양도차익에 대한 과세가 선행되어야 하며 이에 대한 별도의 논의가 필요하다. 본 연구는 현물시장의 증권거래세 부과 이외에 선물시장의 파생상품 소득세 부과의 문제점 및 금융시장에 미치는 영향과 이에 대한 대응방안을 제시하였다. 또한, 파생상품 양도차익 과세가 금융시장에 미치는 영향뿐만 아니라 개인의 세부담에 미치는 영향을 살펴보았다. 본 연구는 현물시장과 선물시장을 분리하여 세제를 살펴보기 보다는 하나의 금융시장의 큰 틀 안에서 소득과세의 나아갈 방향을 제시하였다는 면에서 의의가 있다.

This study addresses the problems on securities transaction tax in the spot market and income taxation on capital gain of financial derivatives in the futures market and evaluates the revision of the income tax law. This study presents the improvement direction for vitalization of the futures market and the spot market. First, it is necessary to make amendments the legislations on securities transaction tax on the spot transaction and income taxation on capital gain of financial derivatives. Second, it is also necessary to allow the deduction carried forward on capital loss of financial derivatives. Third, it is needed to revise the legislations for the minimization of taxpayers' burden about taxation objects and tax rates. Fourth, income taxation on capital gain from the disposition of shares is also needed. This study proposes the problems on securities transaction tax in the spot market and income taxation on capital gain of financial derivatives in the futures market and their effects on financial markets and the improvement measures on them.
