북한의 외국인투자정책과 투자관련법 변동에 대한 소고

A Study on North Korea's Foreign Investment Policy and Law Amendment

북한의 외국인투자에 대하여 북한의 경제정책변화와 교역현황을 중심으로 개괄적으로 파악하였다. 주목할 점은 북한은 현재 많은 외자유치를 희망하고 있으며, 이를 반영하기위해 각종 투자관련 법을 정비하고 작성 중에 있다. 그러나 이러한 북한의 노력에도 불구하고 현실은 통일연구원의 북한투자기업 실패 사례 수처럼 투자를 위한 많은 준비와 이에 따르는 법적 제도적 장치의 정비를 필요로 한다. 특히 남북한 당사자들은 관련 법조문에 대한 정확한 인식과 이해를 필요로 한다. 본 연구에서는 현재 타기관에 소개되지 않은 북한의 외국인투자관련법의 시행규정인 투자 3법의 합영법시행규정, 합작법시행규정, 외국인기업법시행규정을 중심으로 추가, 삭제, 수정된 조항을 2005년 발표된 최신 개정법률에 근거하여 구시행규정(1994년, 1995년 시행규정)과 비교하여 고찰하였다.

This study focuses on the following subjects Firstly, this research surveyed North Korea's foreign investment policy with its economic policy changes and inter-trade statistics. Now, North Korea is making rules and laws related to economic and business legislation. From North Korea's actions, we can infer its economic improvements. As we have discussed the results above, it is necessary that foreign investors exercise caution and take into consideration North Korea's laws as related to investment law and acts in order to avoid investment risk and commercial disputes.
