The Israeli Settlements and the Road Map to Palestine

1993년 오슬로 협정 이후 계속되어 오던 이스라엘 팔레스타인 정치 협상은 이제 중단되었다. 아리엘 샤론이 이끄는 우파 정부의 집권과 2000년 9월 이후 계속되고 있는 제 2차 인티파다는 현재 파국적 위기를 고조시키고 있다. 1949년 제네바 협정과 1979년 유엔 안보리 결의 446호 등의 국제법은 동 예루살렘, 웨스트 뱅크, 가자를 포함하는 이스라엘이 점령한 팔레스타인 전 영토에 적용된다. 이들 국제법은 점령지로 점령국 주민들이 이주하는 것을 금지하고 있다. 그러나 이스라엘은 이국제법들을 위반하면서 점령지에 정착촌건설 사업을 강행하고 있다. 현재 진행 중인 이스라엘 정착촌 건설 계획은 웨스트 뱅크와 가자 전역에 2003년 현재 약 23만 정착민에서 2020년까지 31만 정착민으로 증가시키는 것이다(동 예루살렘제외). 이 지역 분쟁의 정치적 해결을 위한 협상은 미국의 중재하에 이집트와 이스라엘 사이에서 체결된 캠프데이비드 협정(1978)으로부터 시작되었다. 이 협정은 이후 이스라엘과 팔레스타인 정치 협상 과정인, 오슬로 협정들(1990년대)과 로드맵(2003)의 토대가 되었다. 그러나 이스라엘의 중단 없는 공세적인 정착촌 건설 사업은 정치 협상이 표면적으로 내세운 목표, 즉 궁극적으로 이 지역에서 평화를 성취한다는 것과는 정면충돌하는 것이다. 이것은 이스라엘이 주도한 정치 협상의 의도와 목표에 심각한 의문을 제기한다. 본 논문은 일련의 중동 정치 협상 과정에서 체결된 협정들과 이스라엘의 공세적인 정착촌 건설 정책을 동시에 비교 분석함으로써, 현재 위기의 원인과 팔레스타인 국가 수립 가능성을 진단한다.

The Palestinian-Israeli negotiations for a political settlement since Oslo Process of 1990s have been halted. The rise of the right wing Israeli government headed by Ariel Sharon and the second Intifada of September 2000 led us for the last three years to a Palestinian catastrophe and Israeli nightmare. The international laws including UNSCR 446 of 1979 as well as the Fourth Geneva Convention are applicable to the OPT(The Occupied Palestinian Territories) which includes East Jerusalem and must be respected. Nevertheless, Israeli policies continue to confiscate the land and build settlements violating all the previous resolutions as well as Article 49 of the Geneva Convention which emphasize that the occupying power shall not deport or transfer parts of its civilian population into the OPT. In addition, according to UNSCR 446, the policy and practices of Israel in expanding and empowering the settlers in the OPT created the vast settlement areas which will be a major obstacle to achieve any comprehensive, just and lasting settlement for the conflict. But the ambiguities of the original text in the Camp David Accords of 1978, the Oslo Accords, the Road Map have been working for Israeli Occupation policy. Reading carefully the first Camp David Accords as well as the very recent proposal of the Road Map of April 2003 along the line of the continued Israeli settlement policy, one could reach easily a conclusion that the road to a Palestinian State is already blocked even if not leading to a dead end.
