인도의 반덤핑 법규와 적용실태에 관한 연구

A Study on Anti-Dumping laws of India and its Application

우리나라는 인도 등 향후 시장수요가 크게 확대될 것으로 예상되는 국가들로부터 심한 수입규제를 받고 있어 국내 수출기업들이 심각한 위험에 직면하고 있다. 본 연구의 목적은 인도의 반덤핑 법규의 실체와 적용실태의 체계적인 분석을 통하여 인도를 포함한 개발도상국들이 행하고 있는 국내기업 및 산업계에 대한 반덤핑 제소에 대처하기 위한 정책적 시사점을 우리 정부에게 제공하는 것이다. 향후 인도 등 개도국에 의해 행해지고 있는 반덤핑 제도를 활용한 수입규제를 줄이기 위해서는 무역구제제도의 국내 운용기관인 산업자원부 산하의 무역위원회를 중심으로 하는 국가차원의 대책을 마련하여야 한다. 이를 위해서 1) 무역위원회는 아시아 주요 개발도상국의 반덤핑 제도관련 법령을 포함한 통상관련 법･제도에 대한 정보 수집에 노력을 기울여야 한다. 이를 위하여 무역위원회를 중심으로 재외공관 및 해외진출기업, KOTRA, 무역협회, 국가정보원 등이 긴밀히 협조하여 국내업체에 대한 제소 동향 등을 신속하게 파악할 수 있는 체계를 구축하여야 할 것이다. 이를 통하여 국제규범에 부합되지 않는 부분이 파악되거나, 국제규범에 부합되지 않는 법령을 제정하고자 하는 경우, 그리고 무역구제제도의 적용측면에서 제소내용 또는 조사과정에서 부당한 내용 및 절차를 발견할 경우, 무역위원회는 해당국 정부 및 의회에 부당성을 지적하고 이의 시정을 적극 촉구하여야 한다. 2) 이와 같은 방법을 통하여 시정되지 않는 경우에는 동 사안을 WTO에 제소하여 교역상대국의 국제규범에 부합되지 않는 부당한 무역구제법령 및 제도의 적용으로 인하여 발생하는 우리나라 기업들의 피해 구제를 위하여 무역위원회가 강력하게 대처하여야 한다. 2) 무역위원회는 통상마찰 대응 경험이 상대적으로 적고 통상정보력이 취약한 중소업체들을 대상으로 정보제공과 통상대응 교육 및 통상관련 상담, 변호사 알선 등의 적극적인 지원을 강화시켜야 한다.

This thesis aims to provide our government to countermeasure which cope in anti-dumping cases of India about Korean exporting companies by studying substance of anti-dumping laws of India and it's actual application. India is one of the most frequent initiators of anti-dumping cases to protecting their industries. Korean exporting companies receives serious import restriction from India that is expected that market demand is expanded greatly hereafter and face in danger Under such circumstances, to decrease Indian anti-dumping cases for the Korea effectively, ⅰ) Korean Trade Commission(KTC) which is domestic operating agency of trade relief system should strengthen it's investigation ability about anti-dumping laws and cases of India. ⅱ) If anti-dumping laws, system and practice of India has injustice or different from WTO rules, KTC will have to indicate the injustice and urge actively to Indian government and assembly in order to do correction. If this correction doesn't work KTC should fill a lawsuit to WTO about this case and let them know about unreasonable restriction of India to our company. ⅲ) KTC should give more support to the small and medium exporting company which is weak on trade conflict relatively by instructing how to deal with trade conflicts, counseling, arbitrating a lawyer.
