유엔의 2014년 북한인권결의안은 북한 최고지도자의 국제형사재판소 제소를 안전보장이사회에 권고했다. 이것은 인권 침해에 대한 국제사회의 우려가 전례 없이 높아진 결과이다. 이런 변화는 ‘국제인권레짐’ 의 형성 가능성을 의미하는가? 이 질문에 답하기 위해서 강화 요인과제약 요인을 분석했다. 탈냉전으로 인한 민주 정치제도의 확산, 장성택처형과 관련 인맥의 숙청, 북한 인권 문제에 대한 미국 주도의 강력한대처, 국제기구들과 인권 전문가들의 노력 등은 강화 요인이다. 반면, 모든 국가들이 안보와 경제 이익을 인권보다 우선시 하는 국제정치의현실주의적 속성, 북한과의 관계 및 국내 사정에 근거한 중국과 러시아의 거부권 행사, 미국 CIA의 인권 침해 사건, 단일적 정책 결정 절차의 부재 등은 제약 요인이다. 한편, 보다 근본적으로 인권의 국제정치를 분석하는 접근법으로서의 국제인권레짐의 개념은 너무 포괄적이라는문제점을 지니고 있다. 향후 과제로서, 레짐 형성의 범위를 ‘정치범의인권’ 등과 같이 특정 쟁점으로 한정하고 미국의 주도아래 국가 간 협력을 지속적으로 도모하면 분명히 유의미한 성과를 거둘 수 있을 것으로 판단된다. 즉, 이런 조건에서는 강한 인권레짐의 등장을 기대할 수있다.
The United Nations General Assembly adopted, on November 14, 2014, a resolution against North Korea for its human rights, requesting the UN Security Council to refer North Korean leader Kim Jong-un to the ICC. Does this imply the feasibility of an international regime emerging in the issue-area of human rights? Supporting factors include the dispersion of democratic political regimes worldwide after the collapse of the Cold War system, the execution of Jang Sung-taek showing the grave human rights situation in North Korea, leading role of the US as a system determiner, and the efforts of such international organizations as HRW and AI as well as of influential figures. On the contrary, restricting factors include the innate nature of world politics in which every nation pursues its own national interest rather than any universal value as human rights, overruling objections from China and Russia based on their foreign relations with North Korea, the recent CIA torture report which weakened the influence of the US as a leading state, and the lack of any unilateral decision-making process. As of now, it seems not easy to expect any real progress in forming a significant international regime on the human rights issue. However, when focusing on a certain sub-issue like the human rights of innocent political prisoners in North Korea, the regime formation will be easier; a strong human rights international regimes can be realized.
