국세심판제도의 평가와 장단기 개편방안

Evaluation and Reform Measures of Tax Tribunal System in Short and Long－Term

본 연구는 현행 사전․사후조세불복제도 중 사후불복제도를 중심으로 하고 그 중에서도 주로 국세심판청구에 대한 재결 실태와 업무량 실태 분석을 통하여 그리고 제도상 문제점을 검토하면서 이에 대한 국세심판제도의 효율적인 개편방안을 다음과 같이 제시하고자 한다. 먼저 국세심판제도의 운영실태상 문제점에 대한 개선방안으로는 첫째, 인용율 제고와 제도개혁에 의한 납세자권리의 신장이 있어야 한다. 둘째, 업무량을 고려하여 국세심판관과 조사관의 대폭적인 증원이 있어야 한다. 셋째, 국세심판관의 임기와 신분이 보장되어야 한다. 다음으로 국세심판제도의 제도상 문제점에 대한 개선방안으로는 첫째, 국세심판원 지방지원을 최소한 부산․대구․광주에 설치할 필요가 있다. 둘째, 행정심급 중 국세청은 사전구제제도인 과세전적부심사․과세전적부재심사제도를, 국세심판원은 사후구제제도로써 심판청구를 담당하도록 하며 또한 장기적 개편 방안에서 모색되는 국세심판제도의 준사법적 절차의 강화를 통해 현행 행정법원, 항소법원, 상고법원의 3심급인 사법심급의 단순화가 역시 모색되어야 할 것이다. 셋째, 현행 국세심판원 심판청구와 지방세 2차 심사청구를 조세심판청구로 통합하여 국무총리 소속의 조세심판원으로 통합 개편하는 것이 장기적 관점에서 바람직스럽다. 넷째, 국세심판원을 폐지하면서 사법심인 조세법원을 설치한다.

The purpose of this study is analysis the actual conditions and service in appeal to tax tribunal and review the problems and propose efficient reform measures in that system. Efficient reform measures in Appeal to Tax Tribunal(ATT) are as follows： First, we should consider in admission and improve in the right of taxpayer by the reform in system. Second, as the service is increase, we should increase in many tax judges and inspectors. Third, we should guarantee their term of office service and their social position. Reform measures in Tax Tribunal System are as follows： First, we need to relief a documentary examination principle, add an oral examination theory, introduce liberal belief ideas, and accept the examination of a witness. Second, we need to establish local tax judge in Busan, Daegu and Gwangju. It is desired to integrate both ATT in national tax tribunal and appeal for review in local tax and establish Tax ATT in long－term viewpoint. Third, it is desired to include Tax ATT to the Administrative Office under the premier. Fourth, we should substitute tax court of justice for tax judge.
