K-웹툰을 위협하는 사이버범죄에 대한 대응방안

A Study on the Response to Cybercrime Threatening K-Webtoon

K-웹툰이 전 세계적으로 관심을 받게 되면서 한국의 위상이 높아지고 있으며, 웹툰산 업도 발전하고 있다. 그러나 그에 비례하여 K-웹툰과 관련된 사이버범죄도 증가하고 있다. 그동안은 K-웹툰의 침해 문제가 단지 저작권 침해 차원에서만 다루어졌지만, 이제부터는 경제범죄, 사이버범죄 차원에서 다루어져야 한다. 그러나 한국의 형사사법이 사이버범죄에 대응하는 것에는 한계가 있다. 이는 현행 법체계가 아날로그 사회를 기반해서 구축되었기 때문이다. 그래서 본 논문에서는 K-웹툰을 공격하는 사이버범죄의 현황과 유형, 현행 법률의 한계, 그리고 대응방안에 대해 살펴보았다. 결과적으로 산업계에서는 지속적인 모니터링과 피해 규모 추정의 명확성을 높일 필요가 있다. 정부는 대국민 홍보를 강화하고, 산업계와 함께 모니터링을 강화하며, 국제공조 강화방안을 마련하고, 해당 범죄를 범죄단체조직죄 차원으로 다루어 처벌을 강화하고, 범죄수익환수를 용이하게 할 수 있는 방안을 모색할 필요가 있다. 그리고 입법부는 불법웹툰 서버에 대한 문제를 경제범죄로 다룰 수 있는 근거법률을 마련하고, 범죄수익을 환수할 수 있도록 법적 근거를 도입하며, 온라인수색과 같이 수사기관이 사이버범죄에 대응할 수 있는 강제수사 방법을 입법할 필요성이 있다. 김구 선생님께서는 “나의 소원”에서 한국이 문화 강국이 되기를 소원하셨다. 그 소원이 이제 현실이 되고 있다. 지금 한국은 세계 문화의 한 주류로서 우뚝 서가고 있으며, 그 한 가운데 바로 K-웹툰이 서 있다. 하지만 K-웹툰에 대한 관심과 영향력이 켜진다고 해서 작가들이 언제나 꽃길을 걸어가는 것은 아니다. 사이버범죄라는 어둠이 그들의 길을 위협하고 있기 때문이다. K-웹툰을 위협하고 있는 사이버범죄에 적절하게 대응하는 방안을 모색하지 않는다면 문화 강국의 문턱에서 좌절할 수도 있을 것이다. 우리는 K-웹툰이 처한 문제점에 대해 계속해서 관심을 갖고, 대응방안을 모색하는 공론의 장을 만들며, 구체적인 실천을 통해 K-웹툰을 보호해야 한다. 이는 K-웹툰과 관련된 작가나 산업계만의 일이 아니라 국회, 정부, 그리고 모든 국민이 함께 풀어가야 할 공통과제이다.

As K-webtoons receive worldwide attention, Korea's status is increasing, and the Korean webtoon industry is also developing. Along with that, however, cybercrime attacking K-webtoons is also on the rise. Until now, the issue of K-webtoon infringement has been dealt with only for copyright infringement. However, from now on, it should be dealt with in terms of economic crime and cybercrime. The problem is that Korean criminal justice has limitations in responding to cybercrime. This is because the current legal system was built on the basis of analog society. Therefore, in this paper, we examined the current status and type of cybercrime attacking K-webtoons, limitations of current laws, and countermeasures. As a result, the K-Webtoon industry should continuously monitor crime damage and calculate the scale of damage more accurately. The government should strengthen public relations and monitor related crimes. In particular, investigative agencies should strengthen international investigation cooperation and strengthen punishment by treating the crime as an organized crime. The legislature should come up with a law that can deal with the problem of illegal webtoon servers as economic crimes and introduce legal grounds to recover criminal profits. And measures should be legislated to allow investigative agencies to respond appropriately to cybercrime, such as online search. Korea stands tall as a mainstream of world culture. One of them is the K-Webtoon. However, cybercrime is threatening the K-Webtoon. Therefore, it is necessary to find a way to respond appropriately to the cybercrime. Citizens should continue to pay attention to the threat posed by K-webtoons. In addition, countermeasures against cybercrime should be discussed in the public debate. This is not just a problem for K-Webtoon writers or their industries. The legislature, the government, and all the Korean people should solve it together.
