오랜 역사에서 인형은 생활의 일부로 존재하였다. 특히 어린이들의 성장과정에서 인형의 존재는 다양한 정서발달에 기여하는 도구로 큰 의미를 가진다. 그런데 최근에 ‘성인용 리얼돌’에 대한 사회적 논란이 커지고 있다. 성인용 리얼돌은 성적 도구로 활용할 목적으로 제작된 것으로 사람의 실제 모습과 유사하고 성적 기능을 한다는 점에서 성문화와 청소년 보호를 중심으로 논란을 초래하였다. 그리고 성인용 리얼돌의 수입통관 보류처분에 대한 대법원의 취소판결은 성인용 리얼돌에 대한 규범적 재평가를 확인하였다. 성인용 리얼돌은 이미 국내외에서 크게 확산되고 있는 것이 현실이지만, 성인용 리얼돌의 음란성 또는 반사회성에 대한 논란도 함께 커지고 있다. 도덕적 측면 또는 법적 측면에서 성에 대한 규범적 가치가 성인용 리얼돌의 형태와 기능에 대하여 여전히 사회적으로 강하게 충돌하고 있기 때문이다. 성인용 리얼돌은 과학의 발전에 따라 음성, 움직임 등 더욱 사람과 유사한 안드로이드(Android)로 진화가 이루어질 수 있지만 그 본질은 성기구의 일종으로 성적 취향에 따라 이용하는 도구일 뿐이다. 그러므로 성인용 리얼돌에 관한 사회적 논의는 성인용 리얼돌의 특성으로 새롭게 초래하는 지인형 성인용 리얼돌에 의한 인격권 등의 침해와 청소년의 성보호 위험성을 중심으로 규제를 마련하는 데 집중할 필요가 있다. 성에 대한 규범적 가치의 문제는 감성을 수반한다는 점에서 논리적이고 획일적인 규범적 기준을 제시하기는 매우 어렵다. 그러나 성인용 리얼돌 규제의 합리적인 방향성을 논의하여 법제를 마련하는 것이 시급하다고 본다. 특히 청소년의 성보호는 당사자보다 법정책에 의한 보호제도의 정비가 매우 중요한 기능을 한다는 점에서 성인용 아동 리얼돌의 제작과 유통, 소지 전반에 걸쳐 강력한 규제제도가 신속하게 마련되어야만 한다. 아청법에서 ‘아동ㆍ청소년성착취물’에 ‘아동ㆍ청소년 형상 성기구’를 포함하여 용어의 정의와 처벌규정을 정비하고, 대통령령을 활용하여 ‘아동ㆍ청소년 형상 성기구’의 기준과 인증제도를 마련하면, 청소년 아동 리얼돌을 금지하는 합리적인 법제적 기초가 바련될 것으로 본다.

It is very difficult to present a logical and uniform normative standard in that the normative value of sex entails emotion. However, it is urgent to establish a legal system by discussing the reasonable direction of the sex dolls regulation. In particular, the protection of children and youth against sex offenses is very important to improve the protection system by legal policy, so a strong regulatory system must be quickly established throughout the production, distribution, and possession of sex dolls.
