The Meaning of the Aggression/Invasion of Dokdo and National Defense Security

본 연구는 독도현안을 두고 국제법상 “국제 분쟁의 평화적 해결”이라는 기본원칙의 적용에 관한 것이다. 특히 독도 ICJ 회부 제안 다시 말해 당사자간 분쟁 해결이 아닌 제3자에 의한 사법적 해결 및 만일의 무력 사용에 관해 예비 분석한다. 국제법상 제2차 세계대전이후 이미 국제형사재판소(ICC)에서 “침략 범죄”(crimes against peace)를 관할하게 되어 있다. 특히 최근의 우크라이나 사태는 UN 등 국제사회가 이에 대해 주목한다. 전후 전시 범죄를 고찰하고 현존 국제법상 유효한 분쟁해결 방안의 하나로서 “사실조사 또는 심사”(Fact-finding or inquiry)를 통한 독도현안에 대응하는 방안을 제안한다. 역사적 사실에 대한 견해의 차이와 분쟁의 예방 및 악화 방지에 대한 효과적 방안으로 한일간에 활용될 수 있다고 본다. 동아시아의 국방과 안보에 관한 측면에서 다양한 가상 상황을 예상할 때, 이에 대한 정부의 독도 정책에 고려해야하는 기본적 요건과 변수들을 검토하였다. 결론적으로 독도에 관한 한 한국은 방어적인 “수호”이고 일본은 “침략(침탈)”에 해당한다고 결론지을 수 있다.

This study is about the application of the basic principle of "peaceful resolution of international disputes" under international law on the pending issue of Dokdo. In particular, a preliminary analysis is conducted on the judicial resolution by a third party and the use of force, not the resolution of disputes between the parties. Under international law, the ICC already has jurisdiction over "crimes against peace" after World War II. In particular, the international community, including the UN, pays attention to the recent Ukraine crisis. It considers postwar wartime crimes and proposes a plan to respond to Dokdo issues through "Fact-finding or inquiry" as one of the valid dispute resolution measures under existing international law. It is believed that it can be used between Korea and Japan as an effective way to prevent differences in opinions on historical facts and prevent disputes and deterioration. When predicting various hypothetical situations in terms of defense and security in East Asia, the basic requirements and variables to be considered in the government's Dokdo policy were reviewed. In conclusion, it can be concluded that when it comes to Dokdo, Korea is defensively "guardian" and Japan is "invasion".
