본 연구는 학문적 차원에서 ‘이행기 정의’ 개념의 중요성이 증대되고 있음에도 원칙과 내용에 대한 합의가 이뤄지지 않은 채 연구주제에 따라 임의적으로 적용되고 있는 국내 학계 현실을 직시해 해외에서의 이행기 정의 개념의 일반화 노력과 이에 근거한 실천을 비판적으로 평가하고, 그에 따른 함의를 제시했다. 그간 국내에서 이행기 정의에 대한 접근은 법 우위의 시각에서 피상적으로 이뤄져 왔기에 학문적, 실천적 확장성에 한계가 있었고, 과거사 연구주제의 편향과 한정성의 원인이 되었다는 것이 문제의식이었다. 이런 점에서 이 연구는 한국의 바람직한 과거 청산을 위한 이행기 정의의 이론적인 준거 틀을 확립하는 데 필요한 기초 정보를 제공함과 아울러 관련 논의를 진작시키는데 기여할 수 있을 것으로 기대된다.
This study critically evaluated the generalization efforts of the concept of ‘transitional justice’ and the practices based on them abroad and suggested its implications in the domestic academic world, which transitional justice is arbitrarily applied according to the research topic without consensus on principles and contents even though the importance of transitional justice concept is increasing at the academic level. Since the approach to the definition of transitional justice in Korea has been superficially made from the perspective of legal superiority, there has been a limit to academic and practical expansion. In this regard, this study is expected to provide basic information necessary to establish a theoretical reference framework for transitional justice for Korea's desirable past liquidation and contribute to boosting related discussions.
