The Meaning of Parliamentary Dissolution in French Politics

3,4공화국에서 극심한 내각불안정을 겪었던 프랑스는, 5공화국 헌법 제정 당시, 내각제의 개선책 중 하나로 대통령을 공공권력기관의 정상적인 운영을 보장하는 중재자로 두고 상당한 고유권한들을 부여하였다. 그렇게 프랑스 5공화국에서 의회해산권은 오늘날의 일반적인 내각제와 달리, 수상의 제청이나 부서가 필요 없는 대통령의 독자적 권한 중 하나가 되었다. 60년 넘게 존속해온 프랑스 5공화국에서 해산권은 하원인 국민의회를 향해 총 다섯 차례 발령되었다. 다양한 맥락에서 해산권들이 행사되었지만, 체제의 대통령중심제화와 더불어 점점 더 원래의 중재적 권한과는 거리가 있는 대통령의 정략적 수단으로 변질되었다. 해산권이 내각을 장악하기 위한 필수요건인 하원 다수 기반 확보의 도구가 되어버린 것이다. 물론 5공화국 정당정치의 ‘다수화 현상’ 덕분에 결코 해산권이 많은 빈도로 사용되었다고 볼 수 없고 특히 2000년의 대통령 임기 단축을 위한 헌법개정 이래로는 사용된 적이 없다. 그러나 2022년 재선에 성공한 마크롱 대통령이 취임 직후 실시된 총선에서 안정된 하원 다수 기반 확보에 유례없이 실패하면서 그 어느 때보다 해산권 사용의 가능성이 높아져 있다.

France, which suffered severe cabinet instability in the 3rd and 4th Republics, gave considerable powers to the president as a mediator to ensure the proper functioning of governmental authorities. It was one of the prescriptions for reforming the french parliamentary regime. Thus, in the Constitution of the Fifth Republic of France, the right to dissolve parliament is one of the president's independent powers that don’t require the proposition of Prime minister nor ministerial countersignature, unlike today's general parliamentary regimes. In the French Fifth Republic, which has existed for more than 60 years, the right to dissolve was issued five times against the National Assembly. Dissolution power were exercised in various contexts, but with the presidentialization of the system, gradually degenerated into political means of the president, which was far from the original vocation. The dissolution has become a tool to secure a majority base in the National Assembly, which is an essential requirement for taking control of the government. Of course, thanks to the ‘majoritarization’ of the party politics , the right to dissolution cannot be considered to have been used frequently under the 5th Republic. It has not been used any more especially since the constitutional amendment to shorten the presidential term in 2000. However, President Macron, who won re-election in 2022, is more likely to use the right to dissolve than ever as he has failed to secure a stable majority in the National Assembly in the general elections held shortly after taking office.
