남북한 소방법제 통합의 과제

The Task of Integrating the North and South Korean Fire Laws

소방은 화재로 인해 나타나는 파괴적 결과를 예방하고 발생한 화재에 대해서는 피해를 최소화하고자 하는 조직적, 기술적 안전 활동이라고 할 수 있다. 소방 안전을 위해 활동을 제한하고 이행을 강제하기 때문에 사회 체제를 불문하고 대부분 국가에서는강제 규범으로 이를 규율하고 있다. 사회주의 체제를 구현하는 북한에서도 여러 부문법을 통해 계층적으로 소방 규제를 운용하고 있다. 소방 규제는 화재로부터 국민의 생명과 재산을 보호하기 위해 특정 행위를 직접 제한하거나 이행을 강제하는 것이다. 북한은 소방 부문법으로 소방법이 유효하게 작용하고 있음에도 다수의 부문법에서 소방 규제를 도입하여 해당 부문의 화재 안전을 규율하고 있다. 수십 년간 이어온 분단은 긴장과 갈등이 연속되고 있는 남북한이 서로 상생하기 위해서는 남북한의 법제 통합이 우선되어야 할 것이다. 남북한은 분단되기 전까지 하나의 민족으로 한반도에서 생활하면서 수천 년 이래 같은 법문화를 공유하고 있어 법제 통합의 가능성은 유의미하다고 할 것이다. 북한의 소방 규제를 이해하는 것이 남북 소방 법제 통합에 앞서 중요한 연결고리로 작용할 수 있을 것이다. 이 연구는 북한의 각 부문법에서 규제하고 있는 소방 규제의실태를 파악하여 시사점을 제시하고자 한다. 이를 통해 남북한 소방 규제의 통합을 위한 자료로 활용하고 향후 남북한 소방 규제의 법제 통합에 활용하고자 한다.

Firefighting is an organizational and technical safety activity that seeks to prevent the destructive consequences of fire and to minimize damage in case of fire. For fire safety, activities are restricted and implementation is enforced, so regardless of social system, most countries regulate this by compulsory norms. Even in North Korea, which implements a socialist system, firefighting regulations are hierarchically operated through various sectoral laws. Firefighting regulations directly restrict or force implementation of certain actions to protect people's lives and property from fire. In North Korea, although the Fire Protection Act is effective as a firefighting sector law, a number of sectoral laws have introduced firefighting regulations to regulate fire safety in the relevant sector. In order for the two Koreas, which have been in tension and conflict for decades, to coexist with each other, the integration of laws and regulations between the two Koreas should be prioritized. Since North and South Korea lived on the Korean Peninsula as a single nation until division, and shared the same legal culture for thousands of years, the possibility of unification of the legal system would be significant. Understanding North Korea's firefighting regulations can serve as an important link before the integration of inter-Korean firefighting legislation. This study intends to present implications by understanding the actual situation of firefighting regulations regulated by each sectoral law in North Korea. Through this, it is intended to be used as data for the integration of inter-Korean firefighting regulations and to be used for the integration of inter-Korean firefighting regulations in the future
