민주시민교육 방법으로서의 입법교육

Legislative Education as a Method of Civic Education

입법과정은 민주시민으로서 길러야 하는 모든 역량의 총체이다. 의제설정을 위해서는 다양한 통계를 활용하는 수학적 능력이 필요하며 때로는 과학적 사실에 근거하여 주장을 펴야 한다. 상대를 설득하는 과정에는 논증이 필요하므로 철학적 사고와 논리적 말하기 능력은 필수적이다. 그러므로 입법과정을 교육 현장에서 구현하는 것은 그 자체로 민주시민역량 증대를 꾀할 수 있어 민주시민교육 방법으로서 유의미하다고 할 수 있으며, 이렇게 현실의 입법과정을 활용하여 민주시민역량을기르고자 구안된 교육을 입법교육이라고 할 수 있다. 한편 기존의 사회과교육 및 법교육의 내용 또는 토의·토론과 같은교육 방법으로부터 입법교육이 차별화되는 지점은 입법 자체가 실행을전제로 하고 있다는 점이다. 현실의 입법이 법규범을 제정하여 국민의권리와 의무를 규율하듯, 교육에서의 입법 또한 다양한 입장을 조율하여 결정된 바를 학생들의 삶에 반영하기 때문이다. 그러므로 입법교육은 첫째, 사회적 구성주의 관점에서 함께 만든 규칙에 대한 수용성 즉준법의식을 높이는 효과를 가진다. 둘째, 정치 과정 참여의 필요성을체득하는 효과를 가져, 정치효능감의 유의미한 상승이 기대된다. 이러한 효과성에 비해 학계에서 입법교육은 이제 물꼬를 트기 시작한 수준이기 때문에 개념이나 방법적 측면에 대한 전문가들의 다양한논의가 더 필요한 시점이다. 그러므로 본 연구에서는 우선적으로 입법교육과 민주시민역량 사이의 관련성 및 효과성에 대해 논하여 입법교육이 민주시민교육 방법으로서 기능할 수 있는 가능성을 제시하고자 한다.

The legislative process is the sum of all the abilities that must be raised as a citizen of democratic society. For example, in order to make an agenda-setting claim, it is necessary to have the mathematical ability to utilize various statistics, and sometimes the claim must be developed based on scientific facts. Philosophical thinking and the ability to speak logically are also essential because the process of persuading the other person requires debate. Therefore, the legislative process in education can increase the ability of citizens by itself, and can be used as a method of education for citizens. On the other hand, the point that legislative education is differentiated from the other educational contents or methods such as legal education or debate education. Because legislation itself is premised on enforcement. Just as the actual legislation establishes laws and regulates the rights and obligations of the people, the legislation in education also reflects the lives of students that it was decided by coordinating various positions. Therefore, legislative education has the effect of increasing acceptance of the rules. Secondly, it has the effect of learning the necessity of participating in the political process so that political efficacy can be increased. However, compared to these effects, legislative education is at a level that has just begun that many discussions by experts are needed. Therefore, in this study, effectiveness of legislative education, possibility that legislative education functions as a civic education method in the field of school are discussed.
