성폭력 무고 사건의 유형과 동기에 대한 연구

성범죄는 인간의 삶을 파괴하는 잔인하고도 반인륜적인 범죄이며, 이를 근절하기위해 처벌을 강화하고 있다. 동시에 성범죄에 대해 증가하는 형량과 사법제도의 변화와 함께 무고범죄에 대한 우려도 증가하고 있다. 성범죄 무고의 경우 혐의가 제기된 사실 자체로 피고소인의 사회적관계와 삶의 질에 심각한 영향을 받는 등 트라우마적 영향을 미치고, 대중들의 관심은 무고죄에 대한 최종 판결보다도 더 높아 피해자에게 끼치는 해악이 결코 가볍지 않지만, 이에 대한 피해회복이나 명예회복이 쉽지 않다. 또한 무고범죄의 경우 피고인이 허위였음을 인식하고 있었다는 점을 증명해야 한다는 점에서 입증 또한 매우 어렵다. 성폭력 무고 범행의 심각성과 입증의 어려움은 성폭력범죄에 비해 가볍지 않음에도 불구하고, 이에 대한 조사와 연구는 이루어지지 않고 있다. 본 연구는 성폭력 무고범죄의 신고 유형과 고소인의 동기를 살펴보기 위해 2019년 1월 1일부터 2020년 12월 31일까지 2년간 성폭력범죄로 유죄가 선고된 1심 판결 180건을 분석하였다. 분석결과 성폭력 무고범죄의 경우 절반은 집행유예 선고를 받았고, 주된 무고 신고의 종류는 강간과 강제추행이 대다수를이루었다. 무고동기를 실증적으로 살펴본 결과 복수심, 재명명, 후회 등의 감정적 이득을 위한 신고가 대다수였으며, 물질적 이익이나 정서적 문제에 의한 신고는 상대적으로 적었다. 연구의 분석방법과 자료의 한계상 다소 제한적이지만, 본 연구는 상대적으로 경험연구가 부족한 성폭력범죄 무고죄의 유형과 그 동기를 계량적으로 살펴보았다는 의의를 지닌다.

Sexual crimes are considered unethical and immoral, as they destroy human lives. The criminal justice system of South Korea mandates tough punishment for sexual criminals. At the same time, concerns about false accusations of sexual assault are also increasing. A false accusation of rape affects the accused on a very deep level, destroying their social relations and quality of life. Public opinion is largely based on the fact that the accused is under suspicion of sexual assault, rather than on the court’s ruling. In addition, because the accuser’s intent determines the legality or the illegality of the false accusation, accusations are hard to prove and even harder to defend against. Despite the significant social repercussions of false rape accusations, we lack accurate statistics of how frequently they occur and an in-depth discussion of the motives behind them. This study classifies the most reported types of false rape accusations and discusses common reasons and motives that underlie most cases. It analyzes a total of 180 cases that issued sentences for false rape accusations over the past two years, from January 1, 2019 to December 31, 2020. Nearly half of the offenders in these cases were sentenced to probation, while the two main types of reported crimes were rape and indecent act by compulsion. Emotional gains, such as sheer vengeance, re-labelling, and regret, as well as material gains and emotional problems stand out as common motivations for false rape accusations. This study has the potential to shed light on a topic that has so far eluded empirical analysis and open avenues for future research Although the study is limited in terms of analytical methods and data, the research has implications for quantitatively examining the types and motives of false rape accusations, which is relatively lacking empirical research.
